On May 18, 2025, a Lebanese national seeking asylum in the United States filed this lawsuit in the U.S. District Court for the Western District of Washington. Plaintiff was detained by the federal government and scheduled for removal from the United States on May 20. He alleged that the government failed to provide him with a credible fear interview before his removal, in violation of the Administrative Procedure Act and the Immigration and Nationality Act. The case was assigned, then reassigned to District Judge Jamal N. Whitehead.
The court issued a temporary restraining order, ex parte, on May 19 to prevent plaintiff's immediate removal. The court found plaintiff was likely to be successful in showing that the credible fear screening had not taken place. The temporary order forbade El Bitar's transfer from his current detention facility or removal, pending a motion for preliminary injunction.
The parties presented a joint status report on the case on May 27, 2025. Plaintiff voluntarily dismissed this case one day later, on May 28.
