This case challenges allegedly inhumane detention conditions faced by noncitizens held in ICE holding cells in Maryland. On May 9, 2025, a noncitizen detained by U.S. Immigration and Customs Enforcement in holding cells operated by ICE's Baltimore Field Office filed this class action lawsuit in the United States District Court for the District of Maryland; on May 12, a second petitioner and proposed class representative was added in an amended complaint. The petitioners named several ICE officials, the Secretary of Homeland Security, and the Attorney General as defendants. They challenged the inhumane conditions of the holding cells, alleging that defendants denied them access to food, water, necessary medical care, bathrooms, and phones in order to have meaningful access to counsel. They alleged that defendants' actions violated the Administrative Procedure Act and the Due Process Clause. The case was assigned to District Judge Julie Rebecca Rubin.

On May 14, 2025, the court held a hearing on petitioners' emergency motion to prevent their being removed from the United States. That same day, the court issued an order pursuant to the All Writs Act directing that the government not remove either named petitioner. On May 20, the court directed the clerk to re-docket the case as a non-habeas civil action. (For this reason, certain documents on the current docket sheet, under number 1:25-cv-01613, are mis-dated, reflecting the date of transfer to the new docket rather than the original filing date.)

On June 6, 2025, the petitioners filed a motion for class certification, seeking to represent all noncitizens held in ICE Baltimore Field Office holding cells. Then, on June 12, 2025, they filed a motion for a preliminary injunction, seeking an order requiring ICE to remedy the conditions of confinement, including guaranteed access to food, water, bathrooms, medical care, and phones. On June 18, 2025, the State of Maryland filed an amicus brief supporting the motion for preliminary injunction. The brief argued that the alleged conditions violated Maryland’s safety and dignity standards for detention facilities, were unconstitutional, and contrary to the public interest and the State’s values. It urged the court to grant the injunction to compel reforms aligned with constitutional rights and state standards. On July 11, 2025, the petitioners filed a second amended complaint, adding factual allegations and clarifying the proposed class definition. 

The case is ongoing.
