On May 17th, 2025, 13 next-of-friends, on behalf of foster children in the state of Tennessee, filed a class action complaint in the U.S. District Court for the Middle District of Tennessee against the Commissioner of the Tennessee Department of Children’s Services, the Deputy Commissioner of the Tennessee Department of Children’s Services, and the Deputy Commissioner of Child Programs of Tennessee Department of Children’s Services. The plaintiffs filed this class action suit on behalf of over 9,000 children in its foster care system. Represented by attorneys from non-profit legal organizations and private law firms alike, the plaintiffs sued the Tennessee Department of Children’s Services under 42 U.S.C. § 1983, the Adoption Assistance and Child Welfare Act of 1980, the Americans with Disabilities Act and Rehabilitation Act, and the Medicaid Act. The complaint alleged that the state’s foster care system was warehousing children in facilities lacking basic living necessities, contracting with facilities with long records of physical, mental, and sexual abuse, moving children between temporary facilities for an indefinitely long period of time, and providing “overworked and undertrained” caseworkers unable to reliably oversee the children’s wellbeing. The complaint also alleged that the foster care system had previously seen much improvement under court supervision until 2017, as part of the settlement of Brian A. v. Bredesen, Case No. 3:00-CV-00445, but had since undergone a regression in standards of care. Seeking class certification, the children sought for the court to permanently enjoin the state from subjecting them to such treatment, and to require the state to provide all incoming foster children an “adequate and individualized” written case plan within 60 days of entering care. The case was assigned to District Judge Aleta Arthur Trauger.

About one month later, on June 16th, 2025, an amended complaint was filed, in which six additional children were added as named plaintiffs.

On September 5, 2025, the defendants filed a motion to dismiss the first amended complaint. The defendants alleged that the court lacked jurisdiction, and the plaintiffs lacked standing, because the relief sought by plaintiffs was not likely to redress the alleged injuries. The defendants alleged that relief would require this Court to oversee nearly every aspect of the State’s child welfare system, which would interfere with the principles of federalism and comity. Moreover, the defendants alleged that the plaintiffs failed to allege facts to support their claims. 

As of October 2025, litigation is ongoing.
