This lawsuit challenged President Trump’s removal of Shira Perlmutter as Register of Copyrights and Director of the U.S. Copyright Office and the installation of Deputy Attorney General Todd Blanche as acting Librarian of Congress. On May 22, 2025, Shira Perlmutter filed suit in the U.S. District Court for the District of Columbia against Todd Blanche, Paul Perkins (purported acting Register), Sergio Gor (Director, White House Presidential Personnel Office), Trent Morse (Deputy Director, White House Presidential Personnel Office), the Executive Office of the President, and President Donald J. Trump. Perlmutter was represented by Democracy Forward Foundation and Munger, Tolles & Olson LLP.

The case was assigned to Judge Timothy J. Kelly.

On May 8, 2025, President Trump removed Librarian of Congress Carla Hayden and subsequently appointed Blanche—Deputy Attorney General—to act as Librarian, invoking the Federal Vacancies Reform Act (FVRA) and Article II of the Constitution. Two days later, Blanche purported to remove Perlmutter from her position as Register of Copyrights, immediately installing Paul Perkins as acting Register. Perlmutter alleged that the President lacked statutory and constitutional authority to remove Hayden, appoint Blanche as acting Librarian, or remove Perlmutter. Specifically, she argued the FVRA does not authorize the President to appoint acting officials in legislative entities such as the Library of Congress, and that the President’s actions violated the Appointments Clause and separation-of-powers principles. She emphasized that, under federal law, only the Librarian could remove or appoint the Register of Copyrights.

 

On May 22, Perlmutter sought a temporary restraining order (TRO) to enjoin her removal and to reinstate her as Register. Following a hearing on May 28, Judge Kelly denied the TRO, finding that Perlmutter had failed to demonstrate irreparable harm. The court held that her loss of a "statutory right to function" and any alleged institutional harm to the Library and Copyright Office did not meet the high threshold for irreparable harm under controlling D.C. Circuit precedent.

 

On June 10, Perlmutter filed a motion for a preliminary injunction (PI), reiterating claims of irreparable institutional harm and injury to her statutory role. Defendants opposed the motion, arguing that the Library is an "Executive agency" under the FVRA, thus subject to presidential authority, and that Blanche’s appointment and Perlmutter’s removal were lawful. Alternatively, defendants contended that the President possessed inherent constitutional authority to designate an acting Librarian and remove Perlmutter directly.

 

On July 23, the court held oral argument on the preliminary injunction. On July 30, Judge Kelly denied the PI, ruling that Perlmutter again failed to demonstrate irreparable harm, reasoning that temporary deprivation of her role, absent a "genuinely extraordinary situation," did not justify emergency injunctive relief. The court found no compelling evidence that Perlmutter could not be adequately reinstated at a later date, nor any indication that the Copyright Office would suffer permanent institutional harm without her immediate reinstatement.

On July 31, Perlmutter filed a notice of appeal to the D.C. Circuit challenging the district court’s July 30 order denying her preliminary injunction. On the same day, the district court denied defendants’ unopposed motion to stay their deadline to respond to the complaint as moot, ordering instead that the parties submit a proposed briefing schedule for anticipated cross-motions for summary judgment by August 6, 2025.

As of August 2025, the appeal was pending before the D.C. Circuit, and proceedings continued in district court toward summary judgment.
