On May 27, 2025, National Public Radio (NPR), Colorado Public Radio, Aspen Public Radio, and KSUT Public Radio filed this lawsuit in the U.S. District Court for the District of Columbia. The plaintiffs sued President Donald Trump and several federal agencies and officials, including the Office of Management and Budget, the U.S. Department of the Treasury, the National Endowment for the Arts, and the Corporation for Public Broadcasting. The plaintiffs sued under the First and Fifth Amendments, the Administrative Procedure Act, and the Declaratory Judgment Act. The case was assigned to Judge Randolph D. Moss.

Represented by private counsel, the plaintiffs sought declaratory and injunctive relief to block enforcement of Executive Order 14290, titled "Ending Taxpayer Subsidization of Biased Media." EO 14290 directed federal agencies to withhold all funding from NPR and the Public Broadcasting Service (PBS) and prohibited local stations receiving federal grants from using those funds to acquire NPR or PBS programming. The plaintiffs sought a judicial declaration that EO 14290 was unlawful and unconstitutional, along with a permanent injunction preventing federal agencies from withholding funds from NPR, PBS, or their affiliated local stations. The requested relief also included prohibiting restrictions on the use of federal grants for acquiring NPR or PBS programming. The plaintiffs argued that EO 14290 exceeded the President’s authority and constituted unlawful retaliation, viewpoint discrimination, and an infringement on the freedom of association.

A related case was filed on May 30, 2025, by PBS against President Trump and several federal agencies. Like NPR, PBS challenged Executive Order 14290 as an unlawful and unconstitutional attempt to defund public media based on perceived political bias. The PBS complaint raised nearly identical claims under the First and Fifth Amendments, the Administrative Procedure Act, and the Public Broadcasting Act, and sought declaratory and injunctive relief to block the order’s enforcement. The case was assigned to the same judge—Judge Randolph D. Moss—and has proceeded on a parallel track. 

On June 10, 2025, the court granted a joint proposal from the parties to resolve the case through cross-motions for summary judgment. On June 13, 2025, the plaintiffs filed their motion for summary judgment, asserting that EO 14290 lacked any legal basis and violated the APA, the First Amendment, Fifth Amendment, the Spending Clause, and the Public Broadcasting Act’s mandate of editorial independence. The motion was supported by declarations outlining the severe consequences of the order, including the disruption of NPR’s national satellite system—used to transmit emergency alerts—and the financial destabilization of local public radio stations. The plaintiffs sought a declaration that EO 14290 was unlawful and unconstitutional, along with a permanent injunction barring its enforcement.

On July 12, 2025, the defendants filed their motion for summary judgment and opposition to the plaintiffs’ motion, arguing that the claims were not yet “ripe” for judicial review because no actual funding termination had occurred, and therefore no concrete injury had been suffered. They further argued that EO 14290 did not violate the First Amendment, as the government, acting as a patron, has discretion over which speech it chooses to support and may consider content and viewpoint when subsidizing speech. They contended the EO merely chooses not to fund NPR/PBS and does not impermissibly discriminate or retaliate based on viewpoint, nor does it violate associational rights. Defendants also contended that no Fifth Amendment due process violation occurred, since federal grants do not constitute protected property interests, and thus their termination does not trigger Due Process Clause protections. Finally, they asserted that the President is not subject to the Administrative Procedure Act for purposes of injunctive relief, and that Plaintiffs cannot challenge the EO on statutory grounds by seeking to vacate agency implementation acts because no agency had taken final action that could be challenged on statutory grounds.

On July 25, 2025, the plaintiffs filed their opposition to the defendants’ cross-motion for summary judgment and reply in support of their own motion for summary judgment. Plaintiffs argued that EO 14290 constituted “textbook retaliation and viewpoint discrimination.” They asserted that the administration failed to meaningfully dispute the order’s violation of the Public Broadcasting Act, instead relying on procedural barriers and a “patently erroneous understanding of the First Amendment.” Plaintiffs further contended that the order violated due process by being unconstitutionally vague and by depriving NPR of a protected property interest—namely, its eligibility for federal funding. Finally, they dismissed the order’s general disclaimer of compliance with applicable law as meaningless, arguing that its specific prohibitions directly conflicted with existing statutory requirements.

The case remains ongoing.

MINUTE ORDER: Upon consideration of the Center for Judicial Accountability's ("CJA") Motion for Leave to File an Amicus Brief, Dkt. 33, it is hereby ORDERED that the motion is GRANTED in part and DENIED in part. The amicus brief was filed by Elena Ruth Sassower, the "Director" of the Center for Judicial Accountability, who is herself proceeding pro se. Dkt. 33 at 3. Ms. Sassower represents that "CJA is not represented by an attorney." Id. But a corporation or organization "cannot represent itself and cannot appear pro se. It must be represented by counsel." See Alexian Brothers Medical Ctr. v. Sebelius, 63 F. Supp. 3d 105, 108 (D.D.C. 2014); see also Partridge v. Am. Hosp. Mang. Co., LLC, 289 F. Supp. 3d 1, 25 (D.D.C. 2017). Accordingly, the motion is DENIED in so far as the amicus brief is filed by the Center for Judicial Accountability without counsel.
