On May 28, 2025, the National Association of the Deaf (NAD) and two individual deaf members filed this lawsuit in the U.S. District Court for the District of Columbia against President Trump, the Executive Office of the President, the White House Office, the Office of the Vice President, the White House Chief of Staff, and the U.S. Press Secretary. Represented by private counsel, the plaintiffs sought declaratory and injunctive relief requiring the White House to reinstate qualified American Sign Language (ASL) interpreters for all public briefings and related events. The case was assigned to Chief Judge James E. Boasberg. 

The plaintiffs alleged a violation of Section 504 of the Rehabilitation Act, which prohibits discrimination against individuals with disabilities by entities that receive federal funding. They argued that the defendants’ failure to provide qualified ASL interpreters during public briefings denied deaf individuals meaningful access to government communications. The plaintiffs also asserted a First Amendment violation, claiming that the absence of ASL interpretation infringed upon their right to receive information from the government. Finally, they alleged a violation of the Fifth Amendment’s due process and equal protection principles, arguing that the lack of ASL interpreters resulted in unequal treatment under the law. 

Also on May 28, 2025, the plaintiffs moved for a preliminary injunction, claiming that they would suffer irreparable harm without the injunction because the lack of ASL interpretation denied them their "first-class citizenship" and ability to participate fully in civic life. The plaintiffs also argued that the public interest would be served by issuing the injunction, as it would promote the "full and equal participation of deaf and hard of hearing Americans in the democratic process.

On May 30, 2025, defendants moved to designate the case as related to prior pandemic-era ASL interpretation lawsuits, seeking consolidation or reassignment. The court denied the motion on June 6, finding the cases involved distinct parties and claims. That same day, the case was reassigned to Judge Amir H. Ali. Plaintiffs had filed a preliminary injunction motion with their complaint; Judge Boasberg initially set a June 26 hearing, but Judge Ali vacated it after reassignment. Following Plaintiffs’ renewed request, Judge Ali rescheduled the preliminary injunction hearing for July 2, 2025.

On July 25, 2025, plaintiff Matthew Bonn voluntarily dismissed his claims against the defendants without prejudice.

On November 4, 2025, the court issued an order granting and denying in part the plaintiffs' request for a preliminary injunction. The court concluded that the plaintiffs were likely to succeed on their Rehabilitation Act claims after finding that the claim was not barred by the settlement agreement in National Ass’n of the Deaf v. Trump, 486 F. Supp. 3d 45 (D.D.C. 2020) on the basis of claim preclusion. The court also found, contrary to the defendants' arguments, that the plaintiffs did have a private cause of action, as Section 504 was enforceable in cases regarding access to government programming. The court denied some of the "overboard" relief the plaintiffs sought, and consequently only ordered that the “Executive Office of the President, White House Office, White House Chief of Staff, and White House Press Secretary shall immediately begin providing a simultaneous and publicly accessible feed with visible American Sign Language interpretation by a qualified interpreter for all publicly announced White House press briefings conducted by the President or White House Press Secretary that are captured by White House communication channels.” Further, the court ordered the government to file a status report detailing their compliance with the order by November 7, 2025.

On November 10, 2025, the government appealed the court’s order granting the preliminary injunction to the D.C. Circuit Court and also filed notice detailing their efforts to comply with the order. The court then issued an order clarifying the scope of the injunction on November 17, 2025. The court clarified that under the injunction the White House offices were expected to take all reasonable steps to provide a simultaneous and publicly accessible feed with visible American Sign Language interpretation for press briefings including events where the “President or Press Secretary plans to provide information to the press or take questions from the press.” 

The case is ongoing.
