This case challenged Executive Order 14154, “Unleashing American Energy,” Executive Order 14156, “Declaring a National Energy Emergency,” and Executive Order 14261, “Reinvigorating America’s Beautiful Clean Coal Industry and Amending Executive Order 14241,” issued by President Donald Trump.

On May 29, 2025, twenty-two citizens from or residing in Montana filed this lawsuit in the United States District Court for the District of Montana against President Donald Trump, the United States, and several federal agencies and their leaders (Federal defendants). The case was assigned to Judge Dana L. Christensen. 

The executive orders aimed to accelerate fossil fuel production, including the expansion of coal mining, oil drilling, and natural gas extraction. They rolled back federal regulations designed to limit greenhouse gas emissions and scaled back support for renewable energy initiatives and climate research programs. The plaintiffs argued that these orders would increase air and water pollution, contribute to rising global temperatures, and exacerbate climate-related health risks, including respiratory illnesses, extreme weather events, and threats to food and water security.

Represented by private counsel from Our Children’s Trust, a nonprofit law firm that specializes in youth-led climate litigation, the plaintiffs sought declaratory and injunctive relief to prevent enforcement of the challenged executive orders. Plaintiffs sought judicial declaration that the executive orders exceeded presidential authority. They also requested a permanent injunction barring the federal government and its agencies from implementing or enforcing these orders to protect their health, safety, and environmental rights. 

The plaintiffs asserted that the executive orders violated their Fifth Amendment due process rights by putting their lives and health at risk through increased environmental harm. They claimed the orders exceeded the scope of presidential authority by effectively overriding federal statutes designed to protect the environment and public health, such as the National Environmental Policy Act and the Clean Air Act. Additionally, the plaintiffs alleged that the executive orders created a state-created danger by deliberately fostering conditions that increase climate change impacts, thereby infringing their right to be free from government actions that threaten their safety and well-being.

On June 13, 2025, plaintiffs filed a motion for preliminary injunction to halt the executive orders. 

On August 4, 2025, Federal defendants moved to dismiss for lack of jurisdiction and failure to state a claim. 

On August 13, 2025, the State of Montana, along with 18 other states and the U.S. Territory of Guam (State defendants), were allowed to intervene as defendants in the case. (2025 WL 2336435). State defendants argued that they were entitled to intervene as of right because of significant property and economic interests at stake, or alternatively, requested permissive intervention. The State defendants asserted that the challenged executive orders had delivered substantial benefits to their states through economic growth, job creation, and energy development. State defendants claimed that the plaintiffs’ lawsuit threatened to disrupt those benefits, potentially harming their economies and state budgets. After being allowed to intervene, State defendants filed a motion to dismiss for lack of jurisdiction on August 14, 2025. 

On September 16 and September 17, 2025, Judge Christensen held a hearing on three matters: 1) Plaintiffs’ motion for preliminary injunction, 2) Federal defendants’ motion to dismiss, and 3) State defendants’ motion to dismiss.

On October 15, 2025, Judge Christensen dismissed this case for a lack of jurisdiction. Judge Christensen “reluctantly” concluded that plaintiffs’ claims were unable to be redressed by the court following Juliana v. US. In Juliana, also brought by Our Children’s Trust, the plaintiffs alleged that the US had violated  plaintiffs’ due process rights by enacting and implementing a nationwide energy policy that contributed to climate change. The 9th Circuit dismissed the Juliana plaintiffs’ claims, reasoning that the court did not have the power to do what the plaintiffs requested: scrutinize, monitor, and pass judgment on environmental policy decisions made by the executive and legislature. Here, Judge Christensen noted that “[i]t is beyond the power of an Article III court to create environmental policy, which is left ‘for better or worse, to the wisdom and discretion of the executive and legislative branches.’” 2025 WL 2930569 (quoting Juliana, 947 F.3d at 1171-72). An Article III court passing judgment on the legislative and executive actions here would violate the separation of powers. Instead, plaintiffs should turn to the electorate or political branches for a remedy. However, Judge Christensen made explicit that “climate change and the exposure from fossil fuels presents a children’s health emergency,” which may shape future climate change litigation.

Julia Olson, founder of Our Children's Trust and plaintiffs' counsel, has vowed to appeal Judge Christensen's decision.
