This case challenged the May 2025 decision of the Director of the Bureau of Ocean Energy Management (BOEM) to resume work on wind turbines off the coasts of New York and New Jersey. The U.S. Department of the Interior (DOI), BOEM’s parent agency had paused construction of the turbines a month earlier, in connection with President Trump’s January 20, 2025 executive order requiring DOI to investigate all offshore wind energy projects and ascertain whether they would cause harm to the environment or the economy. Plaintiffs, a variety of organizations interested in marine issues including commercial fisheries, animal conservation groups, and a proprietor of a local whale-watching tour, alleged that Defendants’ resumption of work on the turbines violated the Outer Continental Shelf Lands Act of 1953 (OCSLA) and the Administrative Procedure Act (APA).

Plaintiffs filed this lawsuit on June 3, 2025, in the U.S. District Court for the District of New Jersey. The lawsuit sued the United States; the U.S. Department of the Interior, its Secretary, Doug Burgum, its subagency BOEM, and BOEM’s Acting Director; Empire Leaseholder LLC, the owner of the area where the turbines are under development; Equinor, the parent company of Empire; and the Kingdom of Norway, a sovereign nation home to—and majority stakeholder in—Equinor. Plaintiffs sought a declaration that the reinstatement of work permits for the wind energy projects violated the APA and an injunction to reinstate DOI’s original pause on the projects and to require BOEM’s Acting Director to complete the investigation ordered by President Trump. The case has been assigned to Judge Georgette Castner.

On June 12, 2025, plaintiffs moved for a temporary restraining order or preliminary injunction preventing the construction or installation of wind turbines in the area owned by Empire Leaseholder LLC and its parent company Equinor. Plaintiffs based their motion on the claims that OCSLA prohibited the lease of American ocean area to a Norwegian-controlled company and that BOEM’s failure to provide findings in support of its order to resume work violated the APA.

On July 4, 2025, plaintiffs filed an amended complaint adding two more fishing organizations as plaintiffs.

Defendants' deadline to answer was extended to September 8, 2025. On September 8, defendants requested a pre-trial conference to discuss filing a motion to dismiss in response to plaintiffs' complaint.  

This case is ongoing.
