On May 19, 2025, federal prosecutors filed criminal charges against U.S. Representative LaMonica McIver in the District of New Jersey, alleging that she assaulted, impeded, and interfered with federal officers during an unannounced visit to an ICE detention facility in Newark, known as Delaney Hall, where a number of government officials were protesting. The incident occurred on May 9, 2025, when McIver, joined by fellow Representatives Bonnie Watson Coleman and Rob Menendez and Newark Mayor Ras Baraka, attempted to conduct a surprise oversight inspection of the facility. During the visit, a confrontation broke out between officials and law enforcement after officers tried to remove Mayor Baraka from the premises. According to the criminal complaint, McIver allegedly struck or pushed multiple ICE officers during the scuffle. She was charged with two felony counts of assaulting federal officers and later indicted by a grand jury, which added a third count for interfering with law enforcement. McIver made her initial court appearance on May 21, 2025, and was released under standard conditions. A preliminary hearing scheduled for June 11 was cancelled following the indictment returned on June 10. She is represented by Paul Fishman, a former U.S. Attorney for New Jersey, and has plead not guilty, characterizing the prosecution as politically motivated retaliation for her oversight work.

As of now, the case is ongoing, with further proceedings expected later this year.
