In February of 2025, the Trump Administration began terminating federal grant awards awarded by the United States Department of Agriculture (USDA). On June 5, 2025, three nonprofit organizations previously awarded USDA grants filed this lawsuit in the U.S. District Court for the District of Colombia. The case was assigned to Judge Beryl A. Howell. 

This named defendants were:

  • The USDA and its Secretary.
  • The Department of Government Efficiency and its Administrator.
  • The United States Forest Service and its Chief.
  • The Natural Resources Conservation Service and its Chief.
  • The National Institute of Food and Agriculture and its Director. 
  • The Farm Service Agency and its Administrator.
  • The Agricultural Marketing Service and its Administrator.

The complaint alleged that the USDA terminated the grants without due process and in violation of the separation of powers and that the USDA's criteria for termination was unconstitutionally vague. The plaintiffs further claimed that the actions of the USDA were unlawful as well as arbitrary and capricious under the Administrative Procedures Act (APA). Finally, they asserted that the USDA's termination of certain programs exceeded its authority (ultra vires action).

The plaintiffs requested that the court declare the grant termination unlawful, order defendants to vacate and set aside the terminations and return to the status quo, and preliminarily and permanently enjoin defendants from giving effect to or maintaining the terminations and from unlawfully re-terminating the grants.  They also sought fees and costs. 

On June 24, 2025, the plaintiffs filed an amended complaint adding two additional organizations as plaintiffs. On June 26, 2025, the plaintiffs moved for a preliminary injunction, asking the court to preliminarily enjoin the defendants' policy and practice of unlawfully terminating grants and to restore the status quo ante. On July 24, 2025, while the motion for a preliminary injunction was pending, the plaintiffs submitted a notice to apprise the court that plaintiffs' counsel had been approached by others facing grant termination who wished to join the lawsuit if the broad policy and practice were not vacated. They requested that, should relief be limited to the named plaintiffs, they be permitted to amend the lawsuit to add additional plaintiffs and/or seek class certification.

The court held a hearing on the plaintiffs' motion for a preliminary injunction on August 6, 2025. This case is ongoing.
