The Proclamation led to the abrupt cancellation of CBP One appointments and the suspension of processing for individuals seeking protection at those ports. This case challenges those actions.

On June 11, 2025, Al Otro Lado, Inc., a nonprofit legal services organization, and Haitian Bridge Alliance, a nonprofit advocacy group, along with several anonymous noncitizen asylum seekers, filed this class action lawsuit in the U.S. District Court for the Southern District of California against President Trump, the Secretary of the Department of Homeland Security, and other top federal officials. Plaintiffs brought claims under the Administrative Procedure Act, the Immigration and Nationality Act, and the Fifth Amendment’s Due Process Clause. Judge Ruth Bermudez Montenegro was assigned to the case.

Plaintiffs contended that the administration’s actions were arbitrary and capricious and were implemented without proper notice-and-comment rulemaking. They also alleged violations of the Immigration and Nationality Act, claiming that these actions unlawfully expanded and tightened restrictions on asylum eligibility and border processing protocols beyond what Congress had authorized. Additionally, they asserted that these actions violated due process rights under the Fifth Amendment by imposing procedural barriers that effectively restricted access to asylum, denying asylum seekers a fair opportunity to present their claims. These actions resulted in individual plaintiffs facing dangerous conditions and costs, while organizational plaintiffs experienced interference with their core activities of assisting asylum seekers and providing humanitarian aid.

Represented by private and nonprofit counsel, the plaintiffs sought declaratory relief, finding that the defendants had unlawfully deprived the class of access to the U.S. asylum process at ports of entry. They also sought injunctive relief, including setting aside the CBP One cancellation, restoring access to the asylum process at ports of entry for the CBP One Subclass, and ordering the defendants to restore such access for class members. 

On June 25, 2025, the plaintiffs filed a motion for class certification, seeking to represent a proposed class of all noncitizen asylum seekers affected by the CBP One cancellation and asylum shutdown policy.

On September 11, 2025, the defendants filed a motion seeking to dismiss the suit for lack of jurisdiction, failure to state a claim, and to strike the complaint. Afterwards, the court granted joint motions the parties had filed to extend the briefing schedule and to unseal the case. The court ordered plaintiffs file their motion in opposition to defendants' motion to dismiss on or before October 10, 2025, and defendants file their reply on or before October 24, 2025. 

As of November 18, 2025, neither party has filed motions in accordance with the schedule.

This case is ongoing.
