This case challenges the Trump Administration's American Energy Exemption Proclamation, which exempted 68 coal-fired power plants from updated federal limits on hazardous air pollutants. On June 12, 2025, twelve environmental advocacy groups filed this lawsuit in the U.S. District Court for the District of Columbia against President Trump and the U.S. Environmental Protection Agency (EPA) and its Administrator. The plaintiffs claimed violations of the Administrative Procedure Act and the Clean Air Act. Represented by private counsel, the plaintiffs sought a declaration that the Proclamation was unlawful, vacatur of the Proclamation, an injunction barring the EPA from enforcing it, and an order directing the agency to notify affected facilities that the exemptions were invalid. Judge Paul L. Friedman was assigned to the case.

The plaintiffs contended that the President had improperly invoked the narrow exemption power under the Clean Air Act, which applied only to individual “stationary sources” and only where the specific facility lacked available technology and its exemption served the national security interest. They claimed that the Proclamation’s blanket exemption of 68 coal-fired power plants failed to include the individualized findings required by statute, ignored the availability of pollution-control technologies, did not meet the statutory standards of necessity or national interest, and exceeded the legal authority granted to the executive branch under the Clean Air Act.

Additionally, the plaintiffs asserted that the Proclamation and its implementation by the EPA violated the Administrative Procedure Act because the agencies had acted arbitrarily and capriciously, failed to follow notice-and-comment procedures, and lacked a reasoned basis for their decision. 

On September 3, 2025, Judge Friedman ordered the case be held in abeyance until March 3, 2026. A case is held in abeyance for purposes of judicial economy. Here, EPA is reconsidering Biden-era rules created to enforce the Clean Air Act. If EPA issues new rules, the President would no longer need to rely on the Proclamation's blanket exemption. If EPA repeals the existing rules to issue new rules, both the Proclamation and this case would be moot. 

Plaintiffs requested that the court reconsider the abeyance order on October 24. Plaintiffs, in the motion for reconsideration, argued that: 1) New evidence shows that the purpose of the challenged exemptions was to halt Clean Air Act compliance activities; 2) The President has granted two-year exemptions for three other industrial categories, and abeyance would allow EPA to “perpetually dodge review” with the new exemptions in place; 3) Recent FOIA disclosures confirm that the Exemption Proclamation harms public health by requiring coal plants to end investments in pollution-control. Twelve states filed an amicus brief in support of the plaintiffs’ motion for reconsideration on October 29. 

On November 5, Judge Friedman denied the plaintiffs’ motion for reconsideration and ordered that defendants file a status report on EPA’s recent actions by December 30, 2025. 

As of November 27, this case is ongoing.
