On May 22, 2025, the United States sued the cities of Newark, Jersey City, Paterson, and Hoboken, along with their city councils and mayors, in the District Court for the District of New Jersey. The U.S. alleged that the defendants' policies unlawfully interfered with immigration enforcement in their cities. For instance, the U.S. claimed that because of the policies, "the United States lacks the ability to readily obtain from local law enforcement the release date of aliens whom DHS has reason to believe are removable from the United States, and DHS lacks access to such aliens to facilitate the transfer of custody, even where DHS presents a Congressionally authorized civil administrative warrant of arrest or removal." The complaint also listed several instances where the cities had released aliens in spite of legal ICE detainers lodged against them. Overall, the U.S. claimed that the defendants' policies evinced a strong hostility to federal immigration law and, in some circumstances, prevented federal agencies from carrying out their duties. 

The U.S. argued that the defendants' actions violated the Supremacy Clause by passing laws contrary to federal law, by unlawfully discriminating against the federal government, and by unlawfully regulating the federal government. The U.S. asked the court to declare the policies unlawful and to enjoin the defendants from enforcing them. 

The case was assigned to District Judge Evelyn Padin.
