On June 18, 2025, Plaintiffs — a coalition of journalists, legal observers, protestors, and journalist associations — sued the Department of Homeland Security (DHS) in the U.S. District Court for the Central District of California. The complaint alleged that during June, ICE launched a series of operations to arrest immigrants in and around Los Angeles, "setting new sky-high targets for daily immigration arrests and expanding the scope of its operations far beyond immigrants with criminal histories." Protests began almost immediately after news of the arrests began to spread. Plaintiffs alleged that DHS responded with sweeping and excessive force, using tear gas, pepper balls, chemical spray, and rubber bullets. Further, Plaintiffs alleged that DHS targeted members of the press, elected officials, and others exercising their First Amendment rights, including some of the plaintiffs here. 

Represented by private counsel and the ACLU of Southern California, Plaintiffs alleged that DHS's use of force violated their First Amendment rights to assembly, speech, and expressive conduct, as well as their Fourth and Fifth Amendment rights to be free from unlawful seizure and the undue use of excessive force. Plaintiffs requested injunctive relief and court costs. The same day, Plaintiffs filed a motion for a temporary restraining order (TRO). 

The case was assigned to District Judge Stephen V. Wilson, who denied the TRO motion on June 20. The court held that the plaintiffs lacked standing to request a TRO as they “fail to bring any evidence that there is a substantial risk the harm will occur in the future." The court also found the plaintiffs' requested relief to be too broad, since in this case, "the appropriate remedy would be a narrowly crafted injunction prohibiting Defendants from using excessive force to disperse crowds without warning," but the plaintiffs' requested relief "would restrict lawful crowd control measures and potentially impede Defendants' legitimate law enforcement responsibilities." 

On July 9, the case was transferred to District Judge Hernan D. Vera due to its relation to another case before him, Los Angeles Press Club v. City of Los Angeles. On July 18, the plaintiffs filed a motion for a preliminary injunction, seeking to enjoin Defendants’ allegedly excessive use of force and stating that they would suffer irreparable harm without protection from the court. 

The court granted the preliminary injunction on September 10, concluding that federal agents’ use of force had been and would continue to be disruptive to both peaceful protest and media coverage. Judge Vera enjoined Defendants and concluded that Plaintiffs did, in fact, demonstrate an ongoing risk of future injury. 

Defendants appealed the PI in the 9th Circuit Court of Appeals on September 19. On the same day, they also filed an ex parte application in the district court to stay the PI pending appeal. On September 22, the District Court Judge Vera stated that in the nine days it took Defendants to file the ex parte application, they easily complied with the PI without any issues. Thus, they can continue to do so.

The case was opened in the U.S. Court of Appeals for the Ninth Circuit on September 23, along with a posting of the PI briefing scheduling. 

On October 9, Defendants filed another motion to stay the lower court’s PI pending appeal, but this time in the Ninth Circuit. The next day, Plaintiffs filed a motion to strike Defendant’s motion to stay, as the parallel PI motion in the district court had not yet been ruled on.

In light of new factual developments in the case, Plaintiffs filed an amended complaint in the district court on October 16. Among other changes, Plaintiffs asserted the case as a putative class action, added a plaintiff and several defendants, and included that Defendants’ unreasonable use of force pursuant to agency action was a violation of the Administrative Procedure Act. 

On October 21, Judge Vera officially denied the Defendants’ ex parte application to stay the PI pending appeal in district court. Defendants then filed a motion to dismiss the case for lack of standing to obtain equitable relief and failure to state a claim on October 30. They argued that Plaintiffs might’ve been subject to force in the past but could not prove that they’d be subject to it in the future, and that even if Plaintiffs did have standing, their allegations were factually and legally insufficient.

In the Ninth Circuit, the court set a hearing on the merits of both the remaining motion for a stay pending appeal and the motion to strike was set for January 2026.

The case is ongoing.
