The Trump Administration filed this novel lawsuit on June 24, 2025 against the United States District Court for the District of Maryland. The U.S. named all 15 active and senior status judges in the district as defendants, as well as the district's court clerk. 

Initial Complaint

The suit challenged an order issued by Chief Judge George L. Russell III regarding habeas petitions in the district. Hearings related to the Trump Administration's immigration policies were causing strain on Maryland's district court and resulting in cases being handled outside of regular business hours. In response, on May 28, the chief judge issued a standing order enjoining the Executive from removing or altering the legal status of habeas petitioners who have filed their petition in the District Court of Maryland. The U.S. alleged the following:

  • The standing order is effectively an "automatic injunction" that requires the clerk to automatically enter an injunction against altering the legal status of any habeas petitioner in Maryland regardless how frivolous their claim may be. This frustrates the executive branch's immigration enforcement powers.
  • The standing order fails to satisfy the requirements for issuing a preliminary injunction or a temporary restraining order. The "automatic injunction" is issued whether or not the petitioner qualifies for emergency relief and applies relief before a "case or controversy" has been brought.
    • The U.S. further alleged that removal is not "categorically irreparable" harm, and therefore, bars an automatic entitlement to a preliminary injunction against removal.
  • The district courts lack jurisdiction to hear removal proceeding challenges or to issue orders that enjoin execution of removal orders. 

The U.S. brought this case without an explicit statutory cause of action, instead claiming that the federal government may sue in equity to vindicate "its sovereign interests and enjoin interference with its activities." 

The U.S. requested that the court declare the standing order exceed the district court's authority and violated the requirements for local rules. The Executive also requested the District Court of Maryland be prohibited from enforcing the standing order in any case.

This case was originally assigned to Chief Judge George L. Russell III who recused himself and ordered the case be referred to the Chief Judge of the United States Court of Appeals for the Fourth Circuit.

Executive's Motion for a Preliminary Injunction and Defendant's Motion to Dismiss

On July 3, the U.S. moved for a preliminary injunction enjoining the defendants from enforcing the standing orders. The Department of Justice asserted that the orders cause irreparable harm to the Executive Branch by "intruding on its 'sovereign prerogative' over immigration enforcement." The U.S. further purported that the public interest would be served by strong and unencumbered immigration enforcement.

In response, the defendants argued that automatic temporary stays of immigration removals are necessary to avoid the irreversible harm that can be cause by erroneous immigration enforcement. The defendants pointed to automatic temporary stays entered by numerous courts around the country, including the Fourth Circuit. The defendants alleged that despite the routine nature of automatic orders

"The Executive nevertheless responded to this altogether ordinary exercise of the Court's inherent power with a truly extraordinary lawsuit. Instead of challenging the standing orders as applied in an individual case or controversy, the Executive sued the United States District Court for the District of Maryland itself."

The defendants explained that a suit targeting an entire governmental entity instead of raising an objection in an individual case is non-justiciable and creates separation of power problems. Further, they alleged that the U.S. failed to create a credible claim to a cognizable injury. The defendants pointed out that in past cases the federal government has routinely argued that,

"it is not enough for a plaintiff seeking a preliminary injunction to show that the defendant exceeded its statutory authority or that the rule at issue is illegal. . .But the Executive cannot have it both ways—and especially not at the expense of another coordinate branch of government. For similar reasons, the very fact that the Executive is seeking to use its prerogatives to trump those of the Judiciary underscores that the equities do not favor the Executive here."

Further, the defendants moved to dismiss the case. The motion rested on two major claims:

  1. The case is non-justiciable.
    1. The Executive cannot sue an entire branch in its institutional capacity to seek what amounts to an advisory opinion separate from any specific case or controversy.
    2. The Executive does not have a statutory "cause of action" to bring a suit against the judiciary. This is a purposeful decision by congress as attempts to resolve intra-sovereign dispute through inter-branch litigation. creates separation-powers tensions.
  2. Even if the suit is justiciable, the standings orders are valid exercises of the federal courts' authority to "afford themselves time to determine their own jurisdiction." Therefore, the claims fail as a matter of law.
