On March 28, 2025, MSW Media, Inc. and the First Amendment Coalition filed this lawsuit in the U.S. District Court for the Northern District of California under the Freedom of Information Act (FOIA). The plaintiffs sought access to records from the newly renamed U.S. DOGE Service, a White House unit established by President Trump under Executive Order 14158 to implement his “Department of Government Efficiency” initiative.

The plaintiffs alleged that DOGE had quickly assumed sweeping authority over personnel and policy at federal agencies and that Elon Musk was functionally serving as its director. Plaintiffs submitted three FOIA requests between February and March 2025, seeking DOGE email communications (including those involving Musk), communications sent via Signal or personal phones, and related metadata. They also sought to compel DOGE to accept FOIA requests electronically through FOIA.gov, as required by statute.

On April 10, plaintiffs filed a First Amended Complaint adding the Office of Management and Budget (OMB) as a defendant and including a new “pattern or practice” claim that DOGE and OMB were violating FOIA by refusing to accept electronic requests. The federal government moved to dismiss the case or transfer it to the District of Columbia, arguing that venue was improper in California and that DOGE, as a presidential advisory entity within the Executive Office of the President, was not subject to FOIA at all.

On June 18, Judge Araceli Martínez-Olguín granted the government’s motion to transfer the case to the U.S. District Court for the District of Columbia, holding that venue in the Northern District of California was improper under FOIA’s special forum provision and that all claims could be adjudicated in D.C.

The transferred case was assigned to Judge James Boasberg. Defendants filed a motion to stay the case pending resolution of related litigation in CREW v. USDS, which involved overlapping questions about whether DOGE is subject to FOIA and whether discovery into its operations was appropriate. On July 14, Judge Boasberg granted a partial stay of proceedings, allowing plaintiffs to file a limited motion regarding preservation of alleged records while staying the rest of the case pending appellate resolution of the CREW discovery dispute.

This case is ongoing.
