This case is about a detained lawful permanent resident’s challenge to his detention under immigration policies implemented during the Trump Administration. On July 1, 2025, the petitioner filed a petition for a writ of habeas corpus in the U.S. District Court for the District of Minnesota against the President Trump, the Secretary of Homeland Security, the Acting Director of U.S. Immigration and Customs Enforcement (ICE), ICE Enforcement and Removal Operations officers, the Attorney General, the Secretary of Defense, the Warden of the Freeborn County Adult Detention Center, and other federal officials under 28 U.S.C. § 2241 and the Fifth Amendment. Judge Nancy E. Brasel was assigned to the case.

Represented by private counsel from the American Civil Liberties Union of Minnesota, the petitioner sought immediate release from detention, declaratory relief, and an injunction against further detention. He argued that his detention, which had continued during removal proceedings, violated the Fifth Amendment’s Due Process Clause because it lacked individualized justification, meaningful review, and procedural safeguards. He contended that ICE and other federal officials were detaining him based solely on prior criminal convictions, without evidence of current flight risk or danger, in violation of constitutional and statutory requirements. He further argued that continued mandatory detention without a bond hearing under 8 U.S.C. § 1226(c) was unlawful once detention became prolonged and constituted arbitrary detention under due process principles.
