This case challenged the alleged dismantling of AmeriCorps by the defendants through program closures, funding withdrawals, and staff layoffs. AmeriCorps is the federal agency administering national service and volunteer programs. AmeriCorps is run by a Board of Directors and a Chief Executive Officer. AmeriCorps’ Board members and its CEO are all appointed by the President with the advice and consent of the Senate. AmeriCorps comprises multiple statutorily required programs, five of which are relevant here: National Civilian Community Corps (NCCC), Volunteers in Service to America (VISTA), State and National Grants, State Service Commission Subgrants, and the Volunteer Generation Fund. Congress appropriated $975,525,000 for the Corporation’s 2025 operating expenses. Of that amount, Congress earmarked $37,735,000 for NCCC, $103,285,000 for VISTA, $557,094,000 for State and National Grants, $236,917,000 for National Older American Volunteer Programs, $19,538,000 for State Commission Grants, and $14,706,000 for Innovation Assistance and Other Activities.

On May 5, 2025, the plaintiffs, fourteen nonprofit organizations, one labor union, and three individual participants in AmeriCorps programs, filed this lawsuit in the U.S. District Court for the District of Maryland against AmeriCorps, its Interim Agency Head, and the DOGE Team Leader for AmeriCorps. Represented by in-house counsel, counsel from the Democracy Forward Foundation, and counsel from the Democracy Defenders Fund, the plaintiffs alleged that the defendants took several actions to dismantle AmeriCorps in violation of Congress's clear intent (as evidenced by the continued funding of the agency). First, on Tuesday, April 15, 2025, AmeriCorps announced to NCCC Participants, through template letters sent via email, that all NCCC projects were terminated and all Participants would be sent home, effective immediately. Second, the defendants canceled $400,000,000 in AmeriCorps grants, equaling 41% of its budget. Third, on April 16, 2025, approximately 85% of AmeriCorps employees-over 600 AmeriCorps staff members, including about 400 of 429 employees (approximately 93%) represented by Local 2027-were placed on administrative leave. The plaintiffs alleged that these actions dismantled AmeriCorps in violation of statute, and that the employee terminations were unlawful since the actions discussed in the foregoing paragraphs were not taken by a confirmed or Acting CEO, nor by the Board as required by statute. 

Given these violations, the plaintiffs claimed that the defendants' actions were contrary to law and arbitrary and capricious under the Administrative Procedure Act, violated the Separation of Powers, were ultra vires, and violated the Appointments Clause.  The plaintiffs asked the court to declare the defendants' actions were unlawful and to enjoin the defendants from dismantling AmeriCorps. 

The case was assigned to District Judge Matthew J. Maddox. On May 19, the plaintiffs moved for a preliminary injunction, which the court granted on July 7, 2025. The court first rejected the defendants' argument that the Tucker Act barred the court's jurisdiction, since "the source of the legal rights upon which Plaintiffs base their claims are federal constitutional and statutory provisions," not contractual provisions. Turning to the merits, the court found that the plaintiffs "are likely to succeed on the merits of their APA claim that AmeriCorps’ failure to engage in notice-and-comment rulemaking before removing all NCCC members from service, terminating grants, and instituting RIFs for the vast majority of AmeriCorps staff was not in accordance with the law." According to statute, AmeriCorps "shall make any significant changes to program requirements, service delivery or policy only through public notice and comment rulemaking." The court found that this procedural requirement had not been met here, despite the significant changes made by the defendants to the AmeriCorps program. 

Given this failure, the court granted the plaintiffs' motion for a preliminary injunction. The court ordered the defendants to reinstate members of the plaintiff union who had been placed on administrative leave, to reinstate the three individual plaintiffs, and to reinstate all canceled grants and programs. The court also barred the defendants from implementing any more reductions in force or program cancellations. 

The case is ongoing.
