This case challenges the enforceability of the National Firearms Act (NFA) after the One Big Beautiful Bill zeroed the manufacture and transfer tax on most firearms regulated under the NFA. 

On July 4, 2025, Silencer Shop Foundation; Gun Owners of America (GOA); Firearms Regulatory Accountability Coalition (FRAC); B&T USA; Palmetto State Armory; SilencerCo Weapons Research (SilencerCo); Gun Owners Foundation (GOF); and one individual filed this lawsuit in the U.S. District Court for the Northern District of Texas against the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and its Acting Director, the U.S. Department of Justice (DOJ), and the U.S. Attorney General. Plaintiffs challenged the continued enforcement of the National Firearms Act (NFA) following the enactment of the One Big Beautiful Bill Act, which eliminated the manufacture and transfer tax on nearly all NFA-regulated firearms. They alleged that the NFA exceeds Congress's authority under Article I of the U.S. Constitution and sought declaratory relief, declaring the NFA's registration and transfer requirements as unconstitutional, and injunctive relief, preventing the ATF from enforcing the registration and transfer requirements. 

When the NFA was enacted in 1934, it imposed a $200 tax (a little less than $5,000 in 2025 money) on the manufacture and transfers of certain classes of firearms. Thus, Congress justified and the Supreme Court upheld the NFA under Congress's taxing authority. Plaintiffs argued that because the tax has been zeroed out on nearly all NFA-regulated firearms (with the exception of machine guns and destructive devices), the NFA is now unconstitutional as taxing power justification is no longer valid, and there is not another Article I power that justifies the act. 

On August 8, 2025, Plaintiffs filed an amended complaint which added 15 states as plaintiffs and also alleged requiring approval from the federal government before transporting or transferring a short-barreled rifle or shotgun violated the Second Amendment. Plaintiffs additionally added a request for declaratory relief, declaring the NFA unconstitutional under the Second Amendment. Plaintiffs allege that the government cannot bear the burden of showing that there's a comparable historical regulation of short-barreled rifles, short barreled shotguns, or silencers, thus the regulation of these arms is presumptively unconstitutional.  

On October 7, 2025, Plaintiffs filed a motion for summary judgment. On November 20, 2025, the defendants filed a cross-motion for summary judgment, arguing that these regulations are still valid under the taxing power because the regulated businesses are still taxed in other ways, so these regulations are valid without actually creating financial obligations as part of a valid taxing and regulation scheme. Further, these regulations are valid under the Commerce Clause because these are valid regulations of things and businesses in interstate commerce. The defendants also argue that these regulations do not violate the 2nd Amendment because the right to bear arms does not include categories of firearms that are not typically possessed by law-abiding citizens for lawful purposes, which they argue applies to short-barreled shotguns and rifles, and to accessories such as silencers. Further, these regulations are consistent with the federal governments regulation of particularly dangerous weapons that are susceptible to criminal misuse. 

This case is currently ongoing.
