On January 12, 2022, Veronica Escobar, the U.S. Representative for Texas’s 16th Congressional District filed a federal lawsuit in the U.S. District Court for the Western District of Texas against Texas’s Governor, Greg Abbott, and Texas Secretary of State, John Scott, challenging the state’s new congressional redistricting plan as intentionally discriminatory against Latino voters, in violation of the 14th Amendment’s Equal Protection Clause and diluting Latino voters’ voting strength, in violation of § 2 of the federal Voting Rights Act (“VRA”). Escobar sought declaratory judgment that the plan was unconstitutional and unlawful in addition to a preliminary and permanent injunction barring the plan from use in future elections.

On January 13, 2022, Judge David C Guaderrama consolidated this action with several other pending challenges to Texas’s redistricting plans in League of United Latin Am. Citizens (LULAC) v. Abbott. Litigation remains ongoing.
