On August 1, 2023, a federal grand jury in the District of Columbia returned a four-count indictment against former President Donald J. Trump. The indictment alleged that Trump knowingly spread false claims of election fraud to create distrust in the 2020 presidential election and attempted to obstruct the lawful transfer of power. The charges included:

  • conspiracy to defraud the United States under 18 U.S.C. § 371
  • conspiracy to obstruct an official proceeding under 18 U.S.C. § 1512(k)
  • conspiracy against rights under 18 U.S.C. § 241,
  • and obstruction of, and attempt to obstruct, an official proceeding under 18 U.S.C. §§ 1512(c)(2) and 2.

The indictment alleged Trump’s efforts to pressure state officials to alter election results, to enlist the Department of Justice to pursue baseless investigations, and to urge Vice President Pence to reject lawful electoral votes. It also alleged efforts to organize and advance fraudulent slates of presidential electors in multiple states, and to obstruct Congress’s certification of the electoral vote on January 6, 2021.

The case was assigned to U.S. District Judge Tanya Chutkan Following the indictment, Trump filed four motions to dismiss. He argued (1) that Article II and separation-of-powers principles conferred presidential immunity from criminal prosecution for acts taken while in office; (2) that the Impeachment Judgment Clause (Article I, § 3, cl. 7) barred prosecution because he had been impeached and acquitted for related conduct; (3) that the Double Jeopardy Clause of the Fifth Amendment prohibited prosecution following impeachment; and (4) that the indictment was invalid on statutory grounds, asserting that the charged provisions—18 U.S.C. §§ 371, 1512(k), 241, 1512(c)(2), and 2—did not apply to his alleged conduct and that the indictment failed to state an offense.

On December 1, 2023, Judge Chutkan issued a written opinion denying the motions premised on presidential immunity and constitutional provisions. She held that the Constitution does not grant former presidents categorical immunity from federal criminal liability, reasoning that “[f]ormer Presidents enjoy no special conditions on their federal criminal liability.” She explained that separation of powers protects a sitting president’s ability to execute his duties but does not immunize a former president from prosecution. She further rejected Trump’s reliance on the Impeachment Judgment Clause, concluding that the Clause expressly anticipates the possibility of criminal prosecution after impeachment and removal. On the Double Jeopardy Clause claim, she held that impeachment is a political process, not a criminal proceeding, and thus does not trigger double jeopardy protections. United States v. Trump, 704 F.Supp.3d 196 (D.D.C., 2023).

Trump filed an interlocutory appeal of the presidential immunity and double jeopardy rulings. On December 13, 2023, the D.C. Circuit granted the motion. After oral arguments on January 9, 2024, the court affirmed. The D.C. Circuit held that the Constitution provides no “structural immunity” from federal prosecution for a former president. The panel reasoned that neither Article II nor separation-of-powers principles shield a former president from prosecution for conduct alleged to violate generally applicable criminal laws. The court emphasized that accepting Trump’s claim of immunity would effectively place the presidency above the law, a result inconsistent with constitutional text, history, and precedent. United States v. Trump, 91 F.4th 1173 (C.A.D.C., 2024).

Trump then sought review by the Supreme Court. On February 28, 2024, the Court granted certiorari to decide “whether and if so to what extent does a former President enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office.”

On July 1, 2024, the Supreme Court issued its decision, holding that:

  • a former President is entitled to absolute immunity from criminal prosecution for conduct within the scope of his exclusive constitutional authority, such as the pardon power or recognition of foreign governments.
  • It further held that a former President is entitled to at least presumptive immunity for other official acts undertaken in the course of presidential duties. That presumption may be overcome only if the Government shows that prosecution would pose no risk of intrusion on the authority and functions of the Executive Branch.
  • At the same time, the Court held that a former President enjoys no immunity for unofficial acts, defined as conduct outside the realm of presidential responsibilities.

Applying these principles, the Court vacated the D.C. Circuit’s judgment and remanded the case. The decision required the district court to evaluate the indictment count by count, distinguishing between official and unofficial acts, with the burden on the prosecution to show that particular allegations may proceed without infringing on protected presidential functions. Trump v. United States, 603 U.S. 593 (2024).

In the wake of the 2024 presidential election, Trump was declared President-elect. On November 25, 2024, the Department of Justice, citing longstanding Office of Legal Counsel opinions barring indictment and prosecution of a sitting President, moved under Rule 48(a) of the Federal Rules of Criminal Procedure to dismiss the superseding indictment without prejudice. The Government stressed that its decision did not rest on the merits of the case but on constitutional constraints requiring dismissal before inauguration. United States v. Trump, 2024 WL 4880344.

Judge Chutkan granted the unopposed motion, explaining that Rule 48(a) requires “leave of court” to protect against prosecutorial harassment, but that no such concern was present here. She concluded that dismissal without prejudice was consistent with both the rule and DOJ precedent. Accordingly, the prosecution was terminated, subject to the possibility of revival once Trump leaves office. United States v. Trump, 757 F.Supp.3d 82 (D.D.C., 2024).
