Trump in the U.S. District Court for the District of Columbia. The indictment alleged that the Defendant knowingly made false claims of widespread election fraud and asserted that he had won the 2020 presidential election, despite having knowledge that these claims were untrue. The Government alleged that, through the dissemination of these falsehoods, the De…

On August 1, 2023, a federal grand jury returned an indictment against Donald J. Trump in the U.S. District Court for the District of Columbia. The indictment alleged that the Defendant knowingly made false claims of widespread election fraud and asserted that he had won the 2020 presidential election, despite having knowledge that these claims were untrue. The Government alleged that, through the dissemination of these falsehoods, the Defendant fostered a national atmosphere of mistrust and anger, thereby undermining public confidence in the administration of the election.

The grand jury charged the Defendant with engaging in three criminal conspiracies:

  1. Conspiracy to defraud the United States by obstructing and defeating the lawful federal government function of certifying the results of the presidential election, in violation of 18 U.S.C. § 371;
  2. Conspiracy to obstruct an official proceeding -- namely, the January 6, 2021, joint session of Congress convened to certify the electoral vote count -- in violation of 18 U.S.C. § 1512(k); and
  3. Conspiracy against rights, specifically the right to vote and to have one's vote counted, in violation of 18 U.S.C. § 241. 

They further charged the Defendant with obstruction of, and attempt to obstruct, an official proceeding -- the certification of the electoral vote -- in violation of 18 U.S.C. §§ 1512(c)(2), 2.
