It is surrounded by wetlands populated with alligators and venomous snakes. The plaintiffs are immigrants detained at “Alligator Alcatraz,” along with several organizations, including Florida Keys Immigration, the Law Offices of Catherine Perez PLLC, Sanctuary of the South, and U.S. Immigration Law Counsel. On Jully 16, 2025, in the U.S. District Court for the Southern District of Florida, they sued the Department of Homeland Security and its Secretary, the Acting Director of U.S. Immigration and Customs Enforcement (ICE), ICE’s Miami Field Office Director, the Governor of Florida, the Director of Miami-Dade Corrections and Rehabilitation, the Florida Division of Emergency Management and its Executive Director, and the Executive Office for Immigration Review and its Acting Director. The case was assigned to District Judge Rodolfo A. Ruiz II.

Plaintiffs filed a motion for class certification on July 17, 2025, seeking to include “all persons who are currently, or in the future, held at the Alligator Alcatraz detention facility.” On the same day, Plaintiffs sought an expedited motion for a temporary restraining order and a preliminary injunction to ensure access to counsel and the ability to file court documents by July 21, 2025.

Plaintiffs alleged that defendants restricted confidential attorney-client communication, violating detainees’ First Amendment rights to legal counsel and Fifth Amendment due process rights. They claimed the facility lacked standard protocols for private communication, such as in-person visits or unmonitored calls, leaving detainees dependent on infrequent, monitored five-minute collect calls. Attorneys reported that ICE’s detainee locator failed to show client locations, contact emails were invalid, phone calls were disconnected, and legal access was blocked at an armed checkpoint. Even when “Legal Counsel Visitation Request Forms” were provided, they often led to cancellations or no response. Plaintiffs also alleged that the government gave no guidance on which immigration courts handled bond motions, preventing detainees from contesting their detention.

This case is ongoing.

See Plaintiff B v. Francis, 631 F.3d 1310, 1315 (11th Cir. 2011). The Motion establishes that Plaintiffs have a substantial privacy right in proceeding under pseudonyms in this action given that they face the potential of substantial harm in the United States and in their countries of origin from attaching their names to these proceedings. Accordingly, given that Plaintiffs have established good cause in support of their requested relief, the Motion is GRANTED. Plaintiffs seek this leave because they fear that public disclosure of their identities could lead to political persecution and torture; retaliation and harassment by law enforcement, immigration officials, and members of the public; and other harms. Second Mot. at 3-5. "Whether a party's right to privacy outweighs the presumption of openness is a 'totality-of-the-circumstances question.'" Doe v. Neverson, 820 F. App'x 984, 986 (11th Cir. 2020) (quoting In re Chiquita Brands Int'l Inc., 965 F.3d 1238, 1247 n.5 (11th Cir. 2020)). Factors that may counsel courts to grant anonymity to the parties include whether the plaintiffs are challenging government conduct, whether the plaintiffs would be threatened by violence or physical harm by proceeding in their own names, and whether their anonymity would pose a unique threat of fundamental unfairness to the defendant. See Plaintiff B v. Francis, 631 F.3d 1310, 1315 (11th Cir. 2011). The Court has already granted a motion to allow other Plaintiffs in this action to proceed under pseudonyms, and it does so here for similar reasons. See Paperless Order, [ECF No. 15]. The Second Motion establishes that Plaintiffs have a substantial privacy right in proceeding under pseudonyms in this action given that they face the potential of substantial harm in the United States and in their countries of origin from attaching their names to these proceedings. Accordingly, given that Plaintiffs have established good cause in support of their requested relief, the Second Motion is GRANTED.
