This case challenged the January 2025 issuance of a Final Rule issued by the Consumer Financial Protection Bureau (CFPB) which precluded the inclusion of medical debt on consumer reports if they are provided to creditors for the purpose of a credit determination. This case challenged the January 2025 issuance of a Final Rule issued by the Consumer Financial Protection Bureau (CFPB) which precluded the inclusion of medical debt on consumer reports if they are provided to creditors for the purpose of a credit determination. Plaintiffs alleged the CFPB rule violated an express provision of the Fair Credit Reporting Act (FCRA), as amended in 2003 by the Fair and Accurate Credit Transactions Act, allowing such disclosures. Generally, such information must be coded to protect consumer privacy when disclosed, though rules promulgated in 2005 allow for the limited use of non-coded information. Plaintiffs did not dispute the CFPB's statutory authority to regulate non-coded debt information, but argued that the CFPB could not bar the use of coded debt information. Plaintiffs alleged that defendants' actions violated the Administrative Procedure Act (APA).

On January 7, 2025, Cornerstone Credit Union League and Consumer Data Industry Association (CDIA) filed this lawsuit in the U.S. District Court for the Eastern District of Texas against the CFPB and its Director. Plaintiffs sought a declaration that CFPB's Final Rule violated the APA and FCRA and an injunction against the use or enforcement of the Final Rule. The case was assigned to Judge Sean D. Jordan.

On January 10, 2025, plaintiffs filed their motion for a preliminary injunction.

Following the transfer of power from the Biden Administration to the Trump Administration and Trump's firing and replacement of the CFPB's Director, the CFPB moved to stay the proceedings on February 5, 2025. The court granted that unopposed motion the next day.

On February 24, 2025, two nonprofits and two individuals with significant medical debt who stood to benefit from the Final Rule filed a motion to intervene as defendants in this case.

On April 30, 2025, plaintiffs and defendants, but not proposed intervenor-defendants, filed a joint motion for a consent judgment which would hold the Final Rule unlawful.

On May 6, 2025, the court granted proposed intervenor-defendants' motion to intervene and stayed the Final Rule's effect until July 28, 2025. The court also set a hearing for June 11, 2025, on plaintiffs' motion for a preliminary injunction and the joint motion for a consent judgment.

The court issued its final judgment on July 11, 2025. The court found that CFPB's Final Rule violated the plain text of the FCRA and that the agency acted contrary to law under the APA. However, the court dismissed with prejudice plaintiffs' claim that the agency's actions were arbitrary and capricious under the APA. The court vacated the Final Rule in full and adopted the terms of the joint consent decree.
