This case challenges a new policy from the U.S. Immigration and Customs Enforcement (ICE), and the U.S. Department of Homeland Security (DHS), which requires seven days’ advance notice for congressional oversight visits to DHS detention facilities and prohibits visits to certain locations, such as ICE field offices.
On July 30, 2025, twelve individual members of the U.S. House of Representatives filed this lawsuit in the U.S. District Court for the District of Columbia against ICE, DHS, and its respective agency heads. The plaintiffs alleged violations of the Administrative Procedure Act, the Mandamus Act, and the Declaratory Judgment Act, and also claimed ultra vires action and violation of Section 527. Judge Jia M. Cobb presides over the case.
The plaintiffs alleged that the Trump-Vance Administration had stretched the U.S. immigration detention system beyond its capacity, leading to widespread reports of overcrowding, food shortages, inadequate medical care, and unsanitary conditions. They maintained that congressional oversight of DHS and ICE detention facilities was essential to ensuring compliance with federal law and shaping legislation.
Since 2019, Congress has enacted provisions prohibiting DHS from using appropriated funds to block members of Congress from entering detention facilities or requiring advance notice for such visits. The plaintiffs claimed that despite these provisions, a new DHS policy imposed a seven-day notice requirement and barred access to certain sites, including ICE field offices, even when used for detention. They recounted being denied entry to facilities in June and July 2025 under this policy. They further argued that unannounced visits were vital to effective oversight, as prior notice had historically enabled facilities to conceal noncompliance. The plaintiffs asserted that the policy exceeded statutory authority, violated the Administrative Procedure Act, and unlawfully obstructed their constitutional and statutory oversight duties.
Represented by Democracy Forward Foundation and American Oversight, the plaintiffs sought declaratory judgment and an injunction to force the defendants to allow them to conduct unannounced oversight visits.
