This case challenged a new policy from the U.S. Immigration and Customs Enforcement (ICE), and the U.S. Department of Homeland Security (DHS), which required seven days’ advance notice for congressional oversight visits to DHS detention facilities and prohibits visits to certain locations, such as ICE field offices. The lawsuit followed widespread reports of immigration detention overcrowding, food shortages, inadequate medical care, and unsanitary conditions.

Since 2019, Congress has enacted provisions prohibiting DHS from using appropriated funds to block members of Congress from entering detention facilities or requiring advance notice for such visits. Despite these statutes, DHS denied members of Congress entry to facilities in June and July 2025. On July 30, 2025, twelve individual (Democratic) members of the U.S. House of Representatives filed this lawsuit in the U.S. District Court for the District of Columbia against ICE, DHS, and their respective agency heads. Plaintiffs alleged violations of the Administrative Procedure Act, and also claimed ultra vires action. Represented by Democracy Forward Foundation and American Oversight, the plaintiffs sought declaratory judgment and an injunction to force the federal government to allow them to conduct unannounced oversight visits.

The case was assigned to Judge Jia M. Cobb.

On August 8, 2025, plaintiffs filed a motion to stay the implementation of ICE’s policy, and asked the court, in the alternative, to grant a preliminary injunction to stop the implementation of ICE’s policy. The hearing on the motion was scheduled for September 25, 2025.

After a temporary pause of the case due to the government shutdown, on December 17, 2025, the court granted the plaintiffs' motion for a stay of agency action under 5 U.S.C. § 705. It reasoned that plaintiffs were likely to succeed on the merits of their claim that the challenged policies violated the appropriations rider (Section 527), which prohibited DHS from using appropriated funds to prevent members of Congress from entering DHS facilities and otherwise restrict the limitations that may be placed on Congressional access. The court further reasoned that the plaintiffs faced irreparable harm if not able to access the facilities to glean "time-sensitive and highly probative" information relevant to their duties, and that the public interest and balance of equitable considerations weighed strongly in favor of a stay. It therefore stayed the challenged policies related to oversight visits pending conclusion of the review proceedings. 2025 WL 3653597.

On January 10, 2026, the defendants notified the court that they had updated their policies with respect to visitation protocols. In a letter sent to ICE personnel, Secretary Noem said that requests must be made seven days in advance, with any requests to shorten that time requirement needing approval from Secretary Noem. Despite her stated disagreement with the Court's previous decision, Secretary Noem specified that ICE agents were required to ensure that this policy is implemented exclusively with money appropriated by the 'One Big Beautiful Bill Act' (OBBBA). Noem stated that this advanced notice policy was "necessary to ensure adequate protection for Members of Congress, congressional staff, detainees, and ICE employees alike," and to prevent "circus-like publicity stunts" from taking place.

On January 12, Plaintiffs submitted a motion for an order to show cause as to why show cause why the duplicate notice policy submitted by the defendants is not in violation of section 527. Further, plaintiffs requested an emergency hearing in response to DHS blocking three members of Congress from conducting oversight at a facility near Minneapolis, Minnesota, days after the shooting of Renee Good by an ICE agent. The court set a hearing for January 14, 2026. Prior to the hearing taking place, defendants submitted a declaration from Holly C. Mehringer, a financial officer within DHS, where Mehringer detailed DHS's immigration budget and declared her office would track their spending to "ensure that all charges related to enforcement of the January 8 access policy are properly recorded." At the hearing, the Court barred defendants from implementing their updated visitation policy until they can demonstrate that "no section 527 funds are used or will be used to create, promulgate, implement, and enforce a seven-day notice requirement."

The next day, January 13, both parties submitted supplemental memos, as ordered by the court, to further explain and justify their positions. In their memo, plaintiffs asked the court to enforce its 5 U.S.C. § 705 stay order, due to defendants not being about to state definitely during the hearing that they did not use funds subject to section 527 in promulgating and implementing the visitation policy. Additionally, plaintiffs submitted a proposed order, as directed by the Court, seeking to enjoin defendants from implementing their policy. In the defendants' memo, they first stated that their January 8 notice was a new agency action and was thus not in violation of the court's previous stay. Defendants further emphasized that their January 8 notice specifically only allowed for OBBBA funds to be used in implementing the policy and that, according to judicial precedent, their actions should be presumed to be in good faith. Consequently, defendants asked the Court to deny plaintiffs' motion for an order to show cause.

On January 19, 2026, the Court officially denied the plaintiffs' motion for an order to show cause since the January 8 order constituted a new agency action and thus was not subject to the December 17 memorandum opinion. 2026 WL 137017.

On January 26, the plaintiffs filed an amended complaint to add Representative Kelly Morrison to the lawsuit, bringing the total number of plaintiffs to thirteen. Representative Morrison had allegedly been denied access to an ICE facility on January 10. That same day, the plaintiffs filed a motion for a temporary restraining order (TRO) or, alternatively, a stay under 5 U.S.C. § 705 to halt the January 8 notice policy.

On February 2, 2026, Judge Cobb granted the plaintiffs' motion for a TRO. The Court found that the plaintiffs were highly likely to succeed on the merits of their claim that the January 8 policy violated the Section 527 funding restriction. The Court rejected the government's argument that they could use back-end accounting to segregate restricted annual appropriations from allowable OBBBA funds, noting that the creation and enforcement of the policy inherently relied on resources—such as salaries, utilities, and pre-existing facility contracts—funded by the restricted appropriations. The TRO enjoined DHS and ICE from enforcing the advance-notice requirement against the thirteen plaintiffs for 14 days, and the Court waived the standard bond requirement. 2026 WL 265647.

Following a hearing on February 12, the Court extended the TRO for an additional 14 days for good cause, allowing the Court more time to consider the pending motion for a Section 705 stay. The extension was set to remain in effect until March 2, 2026, or until the Court ruled on the stay request, whichever came first.

On February 14, 2026, the defendants filed a notice informing the Court that the funding subject to the Section 527 rider had lapsed at 12:01 a.m. that day. The government argued that because the restricted funds had lapsed, there was no longer any lawful basis for the Court to continue enjoining their conduct.

The case remains ongoing.

Defendants' position is that no funds currently being used to operate ICE detention facilities are subject to the Section 527 appropriations rider at issue in this litigation. See ECF 32 at 1–2. Based on this update, the Parties are ORDERED to submit a joint status report regarding the status of this case in light of the lapse of appropriations. In the joint status report, Plaintiffs will be allowed to respond to Defendants' 32 Notice, if they choose. MINUTE ORDER staying proceedings pending resolution of lapse in appropriations: In the recent 33 joint status report, Defendants have requested a stay of this litigation pending passage of a law providing annual funding for the Department of Homeland Security (DHS). ECF 33 at 4. Plaintiffs take no position on the appropriateness of a stay of the litigation at this time, although they reiterate the urgency of their request for preliminary relief. ECF 33 at 2. It is hereby ORDERED that proceedings in this case are stayed pending the conclusion of the lapse of DHS annual appropriations. This Court has inherent power to stay proceedings to "control the disposition of the causes on its docket with economy of time and effort for itself, for counsel, and for litigants." Landis v. N. Am. Co., 299 U.S. 248, 254 (1936). The Court finds a stay is warranted given the uncertain status of the DHS appropriations provision at issue in this lawsuit pending the outcome of the lapse in appropriations. MINUTE ORDER: The Court advises the Parties that should they wish to offer live testimony at the February 12 hearing on the Section 705 stay request, they must submit a request to the Court in writing at least 48 hours before the hearing, and must provide the Court and all other parties a list of the witnesses to be examined along with an estimate of the time required. Cf. Local Civil Rule 65.1(d) (setting procedures for the taking of live testimony at hearings on applications for preliminary injunctions, but not addressing hearings regarding requests for a Section 705 stay). Because of the factual dispute regarding the scope of expenditures necessary to promulgate and enforce the January 8 policy and Defendants' ability to track these expenditures, the Court is open to hearing from the Parties' declarants who have provided evidence as to those subjects. See ECF 42-1; ECF 49-2; see also In re Cheney, 544 F.3d 311, 312 (D.C. Cir. 2008) (allowing plaintiffs to depose government official who submitted a sworn declaration in order to allow "follow-up questioning on facts [the government] ha[d] itself put in evidence").
