This case challenged the alleged failure of the U.S. Department of Justice (DOJ) and Federal Bureau of Investigations (FBI) to comply with the Freedom of Information Act (FOIA).
The Democracy Forward Foundation (DFF), a public-oriented non-profit, submitted FOIA requests to the DOJ and FBI seeking records concerning the Trump Administration’s handling of the Jeffrey Epstein matter, including internal communications and any related agency reviews. On July 28, 2025, DFF submitted a request for expedited processing of its FOIA request because of widespread media interest, significant public concern regarding government integrity, and potential governmental decisions involving one of Epstein’s alleged co-conspirators. The DOJ Office of Information Policy denied expedited processing under 5 U.S.C. § 552(a)(6)(E)(v)(II). DFF has received no further communication regarding its other requests.
On August 8, 2025, DFF filed this lawsuit in the U.S. District Court for the District of Columbia against the DOJ and FBI, alleging that Defendants’ denial of their expedited processing request violated the FOIA. Plaintiff sought an order compelling Defendants to grant expedited processing, as well as costs and attorneys’ fees. The case was assigned to U.S. District Judge Tanya S. Chutkan.
On August 11, 2025, DFF filed a motion for summary judgment. DFF argued that their request meets the standard of the DOJ regulation (28 C.F.R. § 16.5(e)(1)(iv)) that provides for expedition of requests that “involve . . . a matter of widespread and exceptional media interest in which there exist possible questions about the government’s integrity that affect public confidence.” Defendants filed a memorandum in opposition to DFF’s motion for summary judgment on September 8, 2025, contending that “DFF has not met its burden to demonstrate its omnibus requests for a massive trove of records merit expedition.” DFF filed a reply on September 16, 2025.
The DFF filed an unopposed motion for leave to file an amended complaint on October 1, 2025. The amended complaint added factual assertions that on August 11 and 13, respectively, DOJ’s Mail Referral Unit and FBI acknowledged DFF’s FOIA requests. The Mail Referral Unit responded that DFF’s follow up request had been forwarded for processing, and the FBI assigned the request a tracking number, but informed DFF that “unusual circumstances” would delay the FBI’s ability to make a determination on DFF’s request within FOIA’s deadline of 20 working days. The amended complaint also added a claim alleging that Defendants violated their duties under FOIA by failing to respond to their records requests with determinations within the statutorily mandated time period.
On November 12, 2025, DFF filed notice of “recent developments that heighten the need for expedited court consideration of DFF’s pending motion for summary judgment seeking expedited processing of Freedom of Information Act (“FOIA”) requests concerning the Trump Administration’s handling of the Epstein case and its files.” The recent developments are reports that Ghislaine Maxwell is set to file a commutation application, and a leaked email that suggested Maxwell has information about President Trump’s association with Jeffrey Epstein and the victims of his criminal conspiracy.
