On July 31, 2025, several Honduran citizens and their U.S. citizen children filed this lawsuit in the U.S. District Court for the Middle District of Louisiana against U.S. Immigration and Customs Enforcement (ICE), the U.S. Department of Homeland Security (DHS) and its Secretary; the U.S. Attorney General, and several named and unnamed federal officials.. The case was assigned to District Judge Brian A. Jackson. Plaintiffs are represented by a group of attorneys from the National Immigration Project, Gibson Dunn, Most & Associates, and Ware Immigration. 

Plaintiffs challenge the deportation of U.S. citizen children, along with their noncitizen family members, to Honduras. The complaint alleged that in April 2025, Plaintiffs J.L.V. (“Julia”) and R.M.V. (“Rosario”)—two mothers of U.S. citizen children—attended what they believed to be regularly scheduled check-ins with an ICE contractor; they both brought their children to this encounter. At the meeting, both families were taken into custody and then deported. Plaintiffs were denied their request to speak with counsel when detained. 

As the complaint explained, ICE has a 2022 Directive, ICE Directive 11064.3, Interests of Noncitizen Parents and Legal Guardians of Minor Children or Incapacitated Adults, which sets ICE's standard procedure for handling issues of dependent children of detained parents. The directive provides in relevant part that,“[i]t is the policy of ICE to ensure that the agency’s civil immigration enforcement activities do not unnecessarily disrupt or infringe upon the parental or guardianship rights of noncitizen parents[.]” Directive 11064.3. More particularly, the directive states that “Unless ICE is effectuating an enforcement action against the minor child(ren), ICE personnel should under no circumstances take custody of or transport the minor child(ren).” Instead, it requires ICE personnel to transfer physical custody of children as arranged by the parent facing deportation. 

Plaintiffs allege that the deportation of the citizen children in this case was contrary to the directive and thereby a violation of the APA, and that it also constituted an unreasonable seizure and due process violation. 

Plaintiffs sought declaratory relief and monetary damages. They also requested an order to return the citizen children and their families to the U.S. 

On October 8, the government moved to stay this case during the government shutdown. The stay was granted. However, on October 14, plaintiff moved to lift the stay, citing the urgency of several plaintiffs' return, and the fact that several plaintiffs may be forced to litigate this case from outside the country. On October 22, the court granted the motion lifting the stay. That same day, plaintiffs moved for a preliminary injunction, in which they reiterated the urgency of the matter, and the irreparable harm that plaintiffs, who are currently imprisoned in foreign nations, are likely to face if the case is not resolved swiftly. 

This case is ongoing.
