On August 15, 2025, the District of Columbia filed this lawsuit in the U.S. District Court for the District of Columbia against the President of the United States; the U.S. Department of Justice (DOJ); the U.S. Attorney General; the U.S. Drug Enforcement Administration (DEA) and its Administrator; and the U.S. Marshals Service (USMS) and its Director. Plaintiff challenged the President's action placing the D.C. Metropolitan Police Department (MPD) under direct federal control and delegating command of the Department to the U.S. Attorney General. Plaintiff further challenged the appointment of the DEA Administrator as interim commissioner of the MPD and the assignment of the USMS Director to exercise supervisory command and control over the entire operation of the MPD. The complaint alleged that Defendants' actions violated the Administrative Procedure Act (APA), the Separation of Powers, the Take Care Clause, the District Clause, and were ultra vires.
