On March 21, 2025, the plaintiff in this lawsuit sued the Guilford County Board of Education and the Old North State Medical Society on behalf of her son, alleging that he was given a COVID-19 vaccination without his or his parents' consent. Plaintiffs alleged battery as well as constitutional violations under the state constitution. Both the trial court and Court of Appeals were compelled by the defendants' argument that the Public Readiness and Emergency Preparedness Act (PREP) granted them immunity, dismissing the plaintiff's claims. On appeal, the North Carolina Supreme Court affirmed dismissal of the battery claim, but rejected that PREP could preempt or bar certain state constitution claims.
