In 2009, the U.S. Environmental Protection Agency (EPA) issued an "Endangerment Finding," concluding that greenhouse gases pose a threat to public health and welfare. This finding, based on extensive peer-reviewed scientific research, led to regulations on greenhouse gas emissions. However, in March 2025, the U.S. Department of Energy (DOE) created a secret Climate Working Group. The group, composed of individuals known for their skepticism of climate science, was tasked with creating a report to provide a "balanced" view and challenge the existing scientific consensus. The group's report was submitted to the EPA in May 2025 and was allegedly used by the EPA to justify a proposed rule to rescind the Endangerment Finding. This case challenges the proposed rescission of the Endangerment Finding. 

On August 12, 2025, the Environmental Defense Fund (EDF) and the Union of Concerned Scientists (UCS) filed this lawsuit in the U.S. District Court for the District of Massachusetts against the DOE and its Secretary, the EPA and its Administrator, and the Climate Working Group. The plaintiffs asserted that the defendants’ actions were ultra vires and violated the Federal Advisory Committee Act (FACA) and the Administrative Procedure Act. 

Represented by private counsel, the plaintiffs sought a preliminary injunction to prevent CWG from meeting or acting until the defendants complied with FACA; an order requiring disclosure of all emails, draft documents, and related records to the plaintiffs and the public; an order enjoining the DOE and EPA from using or relying on the CWG’s report; and a writ of mandamus compelling the defendants to perform their duties under FACA.

The plaintiffs alleged that the defendants violated FACA by creating a secret, unaccountable advisory group whose existence, meetings, and records were concealed from the public. They further argued that the group’s five members were deliberately selected for their skepticism of climate science, which was contrary to FACA’s requirements for transparency and balanced representation. Additionally, the plaintiffs argued under the Administrative Procedure Act that the EPA’s proposed rescission of the Endangerment Finding was arbitrary, capricious, and unlawful because it relied on a report produced by the CWG, which had been established in violation of FACA. They maintained that because the report resulted from a tainted process, any agency action grounded in it was invalid.

On August 12, 2025, the plaintiffs filed a motion seeking a preliminary injunction, stay, or alternatively, summary judgment. The plaintiffs asserted they faced irreparable harm from being excluded from the group’s meetings and records, and that the public interest favored transparency in climate policymaking. In the alternative, they requested summary judgment, arguing that the record already established FACA violations beyond dispute.

This case is ongoing.
