Case Summary

This case challenges President Donald J. Trump’s attempt to remove Federal Reserve Governor Lisa D. Cook. On August 15, 2025, Federal Housing Finance Agency Director William Pulte sent a referral letter to the Department of Justice accusing Cook of mortgage fraud related to her 2021 loan applications (prior to her Senate confirmation). This case challenges President Donald J. Trump’s attempt to remove Federal Reserve Governor Lisa D. Cook. On August 15, 2025, Federal Housing Finance Agency Director William Pulte sent a referral letter to the Department of Justice accusing Cook of mortgage fraud related to her 2021 loan applications (prior to her Senate confirmation). On August 20, 2025, Director Pulte publicly released the referral letter, and within 30 minutes, President Trump demanded Cook’s resignation on social media. Two days later, on August 22, 2025, President Trump told reporters he would fire Cook if she did not resign. On August 25, 2025, President Trump posted a letter on Truth Social purporting to fire Governor Cook “effective immediately,” without providing her prior notice or an opportunity to respond.  

Cook responded with this lawsuit, filed in the U.S. District Court for the District of Columbia on August 28, 2025, by private lawyers and the Democracy Defenders Fund. Her complaint asserts that President Trump’s action violates the Federal Reserve Act (FRA), which permits removal of Board members only “for cause.” The complaint contends that the unsubstantiated, pre-confirmation mortgage allegations do not meet this standard, rendering the President’s actions unlawful. It further alleges that Governor Cook was denied her statutory right to notice and a hearing under the FRA, as well as her Fifth Amendment due process rights, because she was deprived of her property interest in her position without any process. The complaint seeks declaratory and injunctive relief to confirm Cook’s continued status as a Board member, prevent enforcement of her removal, and uphold the independence of the Federal Reserve. She simultaneously sought a temporary restraining order.  

The case was assigned to Judge Jia Cobb, who set a hearing for August 29, 2025. Play-by-play on that hearing is here. Judge Cobb granted the plaintiff's motion for a preliminary injunction, requiring on September 10, 2025, that Cook remain a member of the Federal Reserve Board for the duration of the litigation. President Trump appealed the preliminary injunction to the U.S. Court of Appeals for the District of Colombia that same day.

The Government does not oppose this motion. Though sur-replies are generally disfavored, the decision whether to grant leave is committed to the Court's discretion, and courts typically grant leave if the moving party shows the need to contest matters presented to the Court for the first time in the non-movant's reply brief. See, e.g., Ben-Kotel v. Howard Univ., 319 F.3d 532, 536 (D.C. Cir. 2003). In her Motion for Leave, Plaintiff references the need to contest new arguments raised by the Government in their 23 Supplemental Memorandum and to discuss new decisions issued by the D.C. Circuit and the District of Massachusetts that are relevant to this case. Because of the importance of the issues of first impression involved in this case, the Court GRANTS Plaintiff's Motion for Leave to File a Sur-Reply. The Court further observes that the briefing at issue relates to Plaintiff's motion, which means that Plaintiff should usually get the last word. MINUTE ORDER denying 32 Motion for Leave to File Amicus Brief: Upon consideration of non-party Lamar Christopher Chapman, III's 32 motion for leave to file an amicus brief in this case, the Court DENIES the motion. It is within the sole discretion of the Court to "determine the fact, extent, and manner of participation by" an amicus. Hopi Tribe v. Trump, No. 17-cv-2590 (TSC), 2019 WL 2494161, at 3 (D.D.C. Mar. 20, 2019). Local Civil Rule 7(o) requires that a motion for leave to file an amicus brief "shall concisely state the nature of the movant's interest" and "set forth the reasons why an amicus brief is desirable" and "why the matters asserted are relevant to the disposition of the case." The non-party's motion has (1) failed to concisely state his interests in this case and (2) does not establish that his participation as amicus would help the Court better understand matters "relevant to the disposition" of this case.
