This is an ongoing case challenging Georgia state law, SB185, a law that prohibits the provision of hormone therapy and other forms of healthcare for gender dysphoria in GA state prisons. 

On August 8, 2025, five transgender people incarcerated in Georgia filed a complaint on behalf of themselves and all individuals incarcerated in the Georgia Department of Corrections (GDC) who were seeking or receiving gender dysphoria treatment. The plaintiffs sued the Commissioner of GDC, the Assistant Commissioner of the Health Services Division of GDC, the Statewide Medical Director for GDC, and Centurion of Georgia, LLC, the GDC healthcare provider (collectively, the “Georgia Department of Corrections” or “GDC”). Plaintiffs brought the suit under Rule 23(a) and Rule 23(b)(2) of the Federal Civil Rules of Civil Procedure. They alleged that SB185 violated their constitutional rights under the Eighth Amendment and jeopardized the health and safety of hundreds of people in GDC custody with gender dysphoria diagnoses. Represented by the Center for Constitutional Rights and private counsel, plaintiffs sought  injunctive and declaratory relief to ensure that Plaintiffs and Class Members had continued access to the medically necessary care they require. That same day, the plaintiffs filed motions for Provisional Class Certification and an emergency Preliminary Injunction as to have the Defendants continue providing Plaintiffs and Class Members the treatment they had before the SB185 was passed. 

On September 4, 2025 the court granted the plaintiffs’ motion for a preliminary injunction, thus requiring GDC to continue providing treatment to plaintiffs, and granted the motion for class certification. The court found that the plaintiffs receiving hormone therapy were at imminent risk of irreparable harm from withdrawal of treatmentAdditionally, the court found that the proposed class action met all the requirements under Rule 23(a) and Rule 23(b)(2) of the Federal Rules of Civil Procedure. 

On September 5, 2025, GDC  appealed the district court’s order granting the preliminary injunction.
