This case challenges the Department of Homeland Security (DHS) and Customs and Border Protection (CBP)'s sudden en masse termination of the lawful parole status of non-citizens who entered the United States using the government’s “CBP One” app.

Represented by Democracy Forward, plaintiffs filed this putative class action on August 11, 2025, in the U.S. District Court for the District of Massachusetts on behalf of 1) non-citizen individuals whose parole status, secured through the CBP One app, was terminated with a non-individualized mass email notification, and 2) members of the Venezuelan Association of Massachusetts who waited at the U.S.-Mexico border for extended periods while awaiting opportunity to lawfully enter the United States. Judge Allision D. Burroughs was assigned to the case. 

Plaintiffs claimed that defendants violated the Administrative Procedure Act (APA) 5 U.S.C. §706(2)(A). Terminating the parole of plaintiffs en masse was charged as both contrary to law and arbitrary and capricious. The relief sought is vacatur, declaratory relief, and injunctive relief — vacating the decision to terminate parole status, declaration that the revocations of status were unlawful under the APA, and enjoining defendants from enforcing the decision to terminate. 

On September 25, 2025, defendants filed an opposition to plaintiffs’ request to file pseudononymously.

Plaintiffs filed a motion for summary judgment on October 16, requesting that the court vacate defendants’ decision to terminate (and terminate en masse) the parole of the Plaintiff Putative Class, and declare the terminations unlawful.

The next day, the defendants filed a motion to stay proceedings in light of the government shutdown. Judge Burroughs promptly denied the stay. 

On November 6, defendants filed a consolidated motion to dismiss and a cross-motion for summary judgment. Defendants argued that the court lacked jurisdiction to review DHS’s decision to terminate parole because it is a task delegated to the Secretary of Homeland Security. They further argued that, on the merits, there is no requirement that terminations of parole address individualized reasons for termination, and thereby they did not violate standard procedure.

This case is ongoing.
