This lawsuit challenges the Department of Education's designation of the Fairfax County (Virginia) Public Schools as "high-risk" status. "High-risk" status means that all Department funds going towards the school system, including formula funding, discretionary grants, and impact aid grants, will be done only through reimbursement. The Trump Administration justified this placement by claiming that the schools were in violation of Title IX by maintaining a policy that permitted students to access restrooms and locker rooms that aligned with their gender identity. Plaintiff – the Fairfax County School Board – filed this suit  in the U.S. District Court for the Eastern District of Virginia on Aug. 29, 2025. Plaintiff simultaneously sought a temporary restraining order and preliminary injunction, vacating the federal “high-risk” designation and paying all funds previously denied. The case was assigned to Judge Rossie D. Alston Jr.

On September 5, 2025, following weeks of motion practice, the court denied Plaintiffs Motions for Temporary Restraining Order and Preliminary Injunction because the court lacked subject matter jurisdiction. Judge Alston Jr. t reasoned that Plaintiffs explicitly requested money damages, and framed monetary damages in injunctive or declaratory claims, which, under the Tucker Act, does not allow Article III jurisdiction. In that order, the court also dismissed the complaints without prejudice for lack of subject matter jurisdiction. 

On September 9, Plaintiffs appealed the denial of the Temporary Restraining Order and the Preliminary Injunction, and the dismissal. On September 15, 2025, Plaintiffs, now Appellants, filed an Emergency Motion for Injunction Pending Appeal. In this Emergency Motion, Plaintiffs argued that the District Court does have Article III Jurisdiction because a claim for funds improperly denied under Title IX is considered “relief other than money damages.”

This case is ongoing.
