This case challenges the University of Maryland, College Park’s (UMCP) decision to revoke a student group’s authorization to hold an interfaith vigil on October 7th to mourn lives lost in what the group calls Israel’s ongoing genocide in Gaza, as well as its ban on all student-organized events that day. On September 17, 2024, the University of Maryland Students for Justice in Palestine (UMD-SJP) filed this lawsuit in the U.S. District Court for the District of Maryland against UMCP, the Board of Regents of UMCP, and the President of UMPC, Darryll Pines. UMD-SJP brought a First Amendment claim, arguing that the Defendants’ revocation of permission for the October 7th vigil amounted to a complete denial of the group’s right to speak and unconstitutionally censored and penalized the group based on the content and viewpoint of its message. The student group sought injunctive and declaratory relief, as well as attorneys’ fees. The case was first assigned to Judge Peter J. Messitte and later reassigned to Judge Theodore D. Chuang. 

On September 18, 2024, UMD-SJP filed a Motion for a Temporary Restraining Order and a Preliminary Injunction seeking to enjoin the Defendants from imposing special rules on campus for October 7th and to restore the group's authorization to hold its vigil that day. 

On October 1, 2024, the court granted in part and denied without prejudice in part the Plaintiff’s Motion for Preliminary Injunction. The court ruled in favor of the Plaintiff with respect to events on the College Park campus, ordering that Defendants shall in no way impede or prohibit Plaintiff from hosting its proposed October 7 vigil. The court found that (i) UMD-SJP was likely to succeed on its First Amendment claim because UMCP’s revocation was not viewpoint- or content-neutral and not narrowly tailored, with less restrictive safety measures available; (ii) the group would suffer irreparable harm if denied the October 7 event, a date it views as symbolically significant; and (iii) the balance of equities and public interest favored the student group. The court further denied, without prejudice, the student group’s request to remove the ban outside the College Park campus on October 7th. 2024 WL 4361863. 

On May 29, 2025, the court issued an order dismissing the case without prejudice after the court was advised that the action was settled. Pursuant to the settlement, UMCP agreed to pay UMD-SJP a $100,000 penalty for banning the group’s vigil. ​​This Order allowed any party to request reopening the case within 60 days for good cause if the settlement is not completed; otherwise, the dismissal becomes final.

This case is now closed.
