This case is about President Trump’s deployment of more than 2,200 National Guard troops into Washington, D.C., where they are conducting armed patrols, searches, seizures, and arrests under federal command without the Mayor’s consent. On September 4, 2025, on behalf of the District of Columbia, Attorney General Brian Schwalb sued President Trump in his official capacity, as well as the Department of Defense, Secretary of Defense Peter Hegseth, and other top military agencies and officials for declaratory and injunctive relief to end the National Guard's deployment and restore control to D.C. law enforcement officials. Plaintiffs alleged violations of EMAC, lack of emergency justification, unconstitutional command of state guards, and violations of the Posse Comitatus Act and 10 U.S.C. § 275.
