On June 20, 2008, plaintiffs filed a class action complaint alleging that Special Order SO-08-06, or the “Neighborhood Safety Zone” Program (“NSZ Program”), was in violation of the Fourth Amendment. On June 20, 2008, plaintiffs filed a class action complaint alleging that Special Order SO-08-06, or the “Neighborhood Safety Zone” Program (“NSZ Program”), was in violation of the Fourth Amendment.

The NSZ Program was a DC policing initiative involving a system of roadway checkpoints that operated surrounding the perimeter of targeted neighborhoods (“NSZ”). Under the program, officers could stop drivers at the checkpoints and request information and documents from the drivers to determine whether the operator had a “legitimate reason” for entering the NSZ. Four plaintiffs filed this lawsuit under 42 U.S.C. 1983, alleging that they were denied entry at NSZ checkpoints on account of their refusal to provide information regarding their identity, intended activities, and friends and family within the protected zone.

Represented by Partnership for Civil Justice, plaintiffs sought declaratory and injunctive relief, alongside compensatory/nominal damages for rights violations and attorney’s fees. Plaintiffs sought to enjoin the program, and further to prohibit the collection and retention of data on residents collected through the NSZ Program. Plaintiffs proposed a class that included all residents of DC who have a driver’s license. The case was assigned to United States District Judge Richard J. Leon.

On the same day as the complaint, plaintiffs moved for preliminary injunction, seeking to enjoin the further implementation of the NSZ Program. Judge Leon denied the preliminary injunction on October 30, 2008. Plaintiffs appealed to the U.S. Court of Appeals for the District of Columbia. The Court of Appeals reversed and remanded the order denying preliminary injunction on July 10, 2009, concluding that the plaintiffs established the requisites for the granting of a preliminary injunction. The District of Columbia petitioned for rehearing en banc or rehearing on August 10, 2009, but this petition was denied on October 15, 2009.

Back in the District Court, on March 31, 2010, Judge Leon denied class certification, reasoning that class certification was unnecessary given that the relief sought by the named plaintiffs would afford sufficient protection to the proposed class. Plaintiffs moved for reconsideration of the denial on April 27, 2010, but on February 10, 2011, the motion was denied without prejudice in light of a pending settlement.

Parties reached a settlement agreement on August 26, 2010, which included $3,500 in compensatory damages to each of the named plaintiffs and the expungement of all data gathered during the checkpoint programs. Parties also reached an agreement on the coverage of plaintiff’s costs and attorney’s fees on June 14, 2011. The order for release of the records for destruction was made on August 18, 2011. 

This case is now closed.
