On September 10 2025, three plaintiffs, including the former acting director of the FBI, sued the FBI, the DOJ, and other top government officials in the Federal District of District of Columbia. Plaintiffs alleged that FBI director Kashyap P. Patel fired them as retribution for failure to show sufficient political loyalty, as each of them had worked on criminal investigations of President Trump. Plaintiffs alleged violations of the First and Fifth Amendment, as well as the legal nullity and ultra vires nature of their firings. Plaintiffs sought declaratory judgment under 28 U.S.C. §§ 2201 and 2202 as well as a writ of mandamus commanding
Defendants to return them to their respective offices and not remove them from federal service
without following lawful procedure.
