Plaintiff Maurene Comey is the former United States Attorney for the Southern District of New York. Her father, James Comey, served as the Director of the Federal Bureau of Investigation (FBI) from 2013 until President Trump fired him in 2017. After Mr. Comey was fired, he wrote a memoir critical of the president and posted a message on social media the Administration claimed was threatening. In May, Laura Loomer, a politics and social media influencer, posted on social media that Mr. Comey’s “liberal daughter” and her “Democrat husband” to be “FIRED from the DOJ immediately” “for being a national security risk via their proximity to a criminal [i.e., Mr. Comey] who just committed a felony by threatening to assassinate the President.”

On July 15, 2025, the U.S. Attorney's Office allegedly requested that she take the lead on a major corruption case. The next day, she receiveed an email stating that she was being terminated "[p]ursuant to Article II of the United States Constitution and the laws of the United States.” After Ms. Comey's termination, Loomer boasted that the decision happened because of her "pressure campaign on Pam Blondi [sic] to fire Comey’s daughter and Comey’s son-in-law from the DOJ.”

Represented by Clarick Gueron Reisbaum LLP, Ms. Comey subsequently brought this suit in the United States District Court of the Southern District of New York against the Department of Justice, the Executive Office of the President, and the Office of Personnel Management. The plaintiff alleged that the government terminated her due to politically motivated reasons. This termination runs afoul both Article III and the Civil Service Reform Act (CSRA). The plaintiff requested the court declare that the defendants acted unlawfully and an award of backpay/other monetary relief as appropriate.
