On July 18, 2025, President Donald Trump brought this suit against Dow Jones & Company, Rupert Murdoch, and their respective media holdings in the District Court for the Southern District of Florida. Trump alleged Defendants Safdar and Palazzolo had co-authored and published an article falsely claiming that Trump had sent a letter containing a drawing of a nude woman to disgraced financier and convicted sex offender Jeffrey Epstein. Filing as a private citizen through his counsel, Trump claimed defamation per se and defamation per quod, arguing the letter caused him overwhelming financial and reputational harm which would continue to multiply as more individuals read Defendant's article. Trump asked for damages, punitive damages, costs, to a sum no less than $10 billion. The case was assigned to Judge Darrin P. Gayles and Magistrate Judge Jonathan Goodman.

Defendants filed a motion to dismiss on September 22, 2025. Defendants contend that the article is true, pointing out that the House Oversight Committee had since released an identical copy of the letter described in the article at issue, and that the article is not defamatory because there is nothing defamatory about someone sending a letter. Last, defendants contend Trump cannot show they acted with "actual malice."

To support their motion, the defendants filed a Request for Judicial Notice on September 23, 2025. They asked the court to consider twelve exhibits under Federal Rule of Evidence 201, including a subpoena issued to the Epstein estate, a House Oversight Committee press release, the 238-page "Birthday Book" produced by the estate, and various news articles and transcripts documenting Trump’s past public statements. Defendants argued these documents are matters of public record and government publications whose accuracy cannot reasonably be questioned.

On October 20, 2025, Trump filed his opposition to the Motion to Dismiss. Trump maintained that the letter is fake and argued that the subsequent release of documents by Congress does not authenticate the letter or prove he wrote it. He contended the article is defamatory per se because it subjects him to ridicule and hatred by implying a close, "common secret" relationship with a known sex trafficker. Furthermore, he argued the complaint sufficiently alleges actual malice by detailing the defendants' failure to investigate and their reliance on unreliable sources despite Trump's vehement denials. Trump also asserted that Florida’s Anti-SLAPP statute does not apply because his suit has merit.

Simultaneously, Trump filed an opposition to the Request for Judicial Notice. He argued that judicial notice is a narrow tool not intended to resolve disputed facts at the pleading stage. Trump contended that the House Oversight documents lack a chain of custody proving they are the same documents the reporters purportedly reviewed. He further argued that the news articles submitted by defendants constitute inadmissible hearsay and cannot be used to establish the truth of his past comments regarding women or Epstein.

The defendants filed replies in support of both motions on November 5, 2025. In support of dismissal, they reiterated that the House Oversight Committee's release of the letter confirms the article's accuracy, serving as a complete defense regardless of when the document was discovered. They further argued that associating someone with a criminal is not defamatory per se and that Trump’s reputation regarding "locker room banter" renders him effectively libel-proof on the subject. Regarding judicial notice, defendants replied that the "Birthday Book" and letter are incorporated by reference into the complaint and are proper subjects for notice as government records.

Judge Gayles set a hearing on the Motion to Dismiss and Request for Judicial Notice for December 9, 2025.
