This is one of six cases brought by the United States in September 2025 to enforce provisions of the National Voter Registration Act (“NVRA”), the Help America Vote Act (“HAVA”), and Title III of the Civil Rights Act of 1960 (“CRA”). Each suit alleged the states in question failed to maintain their voter registration list to prevent the inclusion of ineligible voters. Further, the complaints argued each state failed to produce its respective list of voters, their addresses, and their social security numbers (the SVRL) when such information was requested by the Attorney General. In certain cases, some states refused or failed to provide a list of voters ruled ineligible due to citizenship status as well as their addresses (the EAVs). In each case, defendants sought injunctive and declaratory relief seeking the disclosure of these records as well as a declaration that any state law that prohibits Defendants from providing the requested statewide voter registration list is preempted by federal law.
