This case concerns a private correctional service’s challenge to a Kansas city’s resolution preventing the company from reopening and managing a detention facility, intended to house immigration detainees for ICE, without first obtaining a Special Use Permit.

On August 8, 2025, CoreCivic, Inc. filed suit against the City of Leavenworth, Kansas, and its City Commission Members over the passage of Resolution No. B-2394. The resolution requires CoreCivic to obtain a local Special Use Permit (“SUP”) before reopening and operating a federal detention facility known as the Midwest Regional Reception Center (the “Property”). The plaintiff claims that Resolution No. B-2394 substantially interferes with and obstructs the congressionally funded and approved enforcement of federal immigration law by U.S. Immigration and Customs Enforcement (“ICE”). In particular, the resolution prohibits performance of the agreement that ICE entered into with CoreCivic in March 2025 to house immigration detainees at the detention center. The case is assigned to District Judge Toby Crouse and Magistrate Judge Gwynne E. Birzer for all proceedings.

CoreCivic filed a motion for preliminary injunction and declaratory relief on September 15, 2025, which it amended on September 26, 2025. The amended motion requests that the Court temporarily enjoin enforcement of a currently active Kansas District Court temporary injunction that gives effect to Resolution No. B-2394, purporting to rescind CoreCivic’s long-established and until-recently-undisputed right to operate the Property. CoreCivic also seeks a declaration that the resolution violates the Supremacy Clause by interfering with CoreCivic’s agreement with ICE to use the detention center to house immigration detainees.

On October 10, 2025, the defendants moved to dismiss for failure to state a claim or, in the alternative, to stay the case pending final resolution of a state court action filed by the City against CoreCivic, which is currently on appeal.

As of November 22, 2025, the Court has not ruled on the motion to dismiss, and the parties have been briefing.

This case is ongoing.

ORDER denying Doc. 5 . Plaintiff CoreCivic filed suit against various Defendants alleging violations of its constitutional rights. Doc. 1. CoreCivic then requested leave to file excess pages in an upcoming motion for a preliminary injunction. Doc. 5. That request is denied. Part of the rationale for establishing page limitations is to focus civil litigants' attention on only the material facts, relevant law, and areas of meaningful dispute. In addition, enforcing page limitations helps prevent overwhelming the record with voluminous and unnecessary legal or factual arguments. See Hon. Michael G. Williamson, The 3-3-3 Rule, https://www.flmb.uscourts.gov/judges/tampa/williamson/3-3-3_rule.pdf, (last visited Sep. 12, 2025) (attributing to Chief Justice Roberts the quip that he had never read a brief and wished it were longer). And nothing in CoreCivic's motion demonstrates that it would be unable to adequately address the pertinent legal and factual issues without additional pages. Contra Doc. 5 at 3. If additional information and/or legal authorities are needed, there will be a separate Order directing the filing of such briefs with specific instructions as to what information is being sought.
