This class action suit concerns a challenge by Latino individuals living in Washington, D.C., to the Trump Administration’s policy and practice of making immigration arrests without a warrant or probable cause, which has sown fear in Latino and other communities across the city.

On September 25, 2025, four Latino individuals residing in Washington, D.C., who were arrested by ICE agents without a warrant or probable cause, filed this class action suit, alongside the nonprofit organization CASA, Inc., against the Trump Administration in the United States District Court for the District of Columbia. The plaintiffs allege that the Administration’s mass immigration arrests in D.C. are being carried out through a policy and practice of warrantless arrests, without individualized determinations of immigration status or flight risk, in violation of clear statutory restrictions on such arrests.

The plaintiffs seek certification of three subclasses: a “Warrantless Arrest Class,” an “Immigration Status Subclass,” and a “Flight Risk Subclass.” On behalf of themselves and class members, they seek declarations that the defendants’ policies and practices are unlawful under 8 U.S.C. § 1357(a)(2), 8 C.F.R. § 287.8(c)(2)(i), the Accardi doctrine, and the Administrative Procedure Act, 5 U.S.C. § 706. They also seek to enjoin the defendants from continuing to conduct arrests without following proper legal procedures.

The plaintiffs are represented by private counsel, the Amica Center for Immigrant Rights, the ACLU, the National Immigration Project, the Washington Lawyers’ Committee for Civil Rights and Urban Affairs, and CASA, Inc. The case was originally assigned to Judge Paul L. Friedman but was randomly reassigned to Judge Beryl A. Howell on October 3, 2025.

On October 3, 2025, the plaintiffs filed a motion for a preliminary injunction, to stay agency action, and for provisional class certification. They argued that unless the Court enjoins or stays the defendants from continuing to make unlawful arrests, the plaintiffs and the putative class will continue to face the possibility of being randomly detained based on race, without due process. That same day, the plaintiffs requested that the Court certify the proposed subclasses.

On October 31, 2025, the defendants filed a motion in opposition to the plaintiffs' motions for a preliminary Injunction and class certification. The plaintiffs replied on November 7, 2025. 

A hearing was held on November 19, 2025 as to the motion for preliminary injunction and class certification. On December 2, 2025, the Court granted the preliminary injunction motion in part. 2025 WL 3465518. It preliminarily enjoined the defendants from enforcing their policy of conducting warrantless civil immigration arrests without probable cause to believe that the arrestee is likely to escape before an administrative warrant can be obtained, as required by 8 U.S.C. § 1357(a)(2) and 8 C.F.R. § 287.8(c)(2)(ii), which also require the same individualized determination of probable cause that the person being arrested is in the United States in violation of law or regulation regulating the admission, exclusion, expulsion or removal of aliens.  It ordered the defendants to comply with reporting requirements, including: documentation of the specific, particularized facts that supported the agent’s pre-arrest probable cause to believe that the person was likely to escape before a warrant could be obtained as well as the facts and circumstances of the arrest; specific details about the person arrested, and not boilerplate language; and documentation of such arrests to plaintiffs' counsel. The court preliminarily certified the proposed Unassessed Escape Risk Class -- defined as: "all persons who, since August 11, 2025, have been or will be arrested in this District for alleged immigration violations without a warrant and without a pre-arrest, individualized assessment of probable cause that the person poses an escape risk" -- and deferred final decision on class certification, denying the pending motion without prejudice.  

In granting preliminary injunctive relief, the court first concluded that the plaintiffs had standing to bring this action.  As to the individual plaintiffs, the court determined that they had clearly established injury in fact based on the alleged existence of an unlawful policy, a substantial likelihood that they were among the group targeted for civil immigration arrests, and a sufficient showing that they could not avoid repeating the quotidian conduct that led to the original arrests. For the same reasons, CASA had associational standing, because its members would otherwise have standing to sue in their own right. The court next rejected the defendants' assertion that the INA stripped it of jurisdiction to review plaintiffs' claims, reasoning that the INA's jurisdiction stripping provisions did not apply because the plaintiffs were challenging neither a final order of removal nor a discretionary prosecutorial decision to commence, adjudicate, or execute removal. The court next held that the plaintiffs had established that defendants’ alleged policy and practice of making warrantless arrests without probable cause was a final agency action. It explained that the record as a whole made clear that the defendants, in practice, had consummated a decisionmaking process that resulted in the implementation of a new policy of conducting warrantless civil immigration arrests based on a lower standard than probable cause. It cited official statements and corroborating evidence from over two dozen declarations describing roughly forty warrantless civil immigration arrests conducted without the requisite probable cause finding. Finally, turning to the plaintiffs' likelihood of success on the merits of their claim, the court reasoned that the defendants’ systemic failure to apply the requirement of probable cause for a civil immigration arrest under the INA, including the failure to consider escape risk, directly violated clear statutory requirements. In light of the irreparable harm plaintiffs faced and considering the balance of equities and the public interest, the court therefore granted preliminary relief.  

This case is ongoing.
