This case challenged the actions of the Social Security Administration (SSA) and the Internal Revenue Service (IRS) in sharing protected taxpayer data with Immigration and Customs Enforcement (ICE) for immigration enforcement purposes, allegedly in violation of the Tax Reform Act of 1976.

In February 2025, ICE requested, and the then-Acting SSA Commissioner provided, tens of thousands of immigrant addresses obtained from SSA records. Subsequently, the IRS and ICE entered into a Memorandum of Understanding (MOU). Invoking a federal-criminal exception to tax confidentiality, the IRS agreed to continue to share taxpayer information about immigrants with ICE. ICE has since continued to request and receive taxpayer data from both the SSA and the IRS.

On September 30, 2025, the Community Economic Development Center of Southeastern Massachusetts (CEDC), along with three other organizations serving immigrant communities, filed this lawsuit in the U.S. District Court for the District of Massachusetts against the Department of the Treasury, the IRS, the SSA, the Department of Homeland Security (DHS), ICE, and the respective leaders of these agencies. The lawsuit was filed along with a Notice of Related Civil Case and a Request to Relate Case to Community Economic Development Center of Southeastern Massachusetts v. I.R.S., et al., No. 25-cv-11949-IT (D. Mass). Plaintiffs brought claims under the Administrative Procedure Act (APA), the First Amendment, the Accardi Doctrine, and on ultra vires grounds. Plaintiffs sought declaratory and injunctive relief, as well as attorneys’ fees. This case was assigned to Judge Indira Talwani. 

In their complaint, plaintiffs alleged that all defendants: (i) violated the APA by acting contrary to law through the disclosure of taxpayer information and by acting arbitrarily and capriciously in failing to consider, among other things, reliance interests and the risk of data errors; (ii) violated the First Amendment by chilling speech, association, and the right to petition through the threatened use and disclosure of tax data; and (iii) acted ultra vires by undertaking agency actions beyond the scope of statutory authorization. The complaint further asserted that the SSA and IRS violated the Accardi Doctrine by departing from their own internal privacy and data protection regulations without formal amendment.

On October 8, 2025, defendants filed a motion for a stay of all pretrial deadlines in light of a lapse in appropriations affecting the Department of Justice, the SSA, the IRS, and the DHS. The motion requested that deadlines be extended until funding is restored and that any deadlines missed during the lapse be adjusted accordingly. Plaintiffs filed an objection to this motion on October 22, 2025. On November 6, 2025, the court denied the defendants’ request to stay proceedings, concluding that Plaintiffs’ interests in moving the case forward outweighed the defendants’ interest in a delay.

On November 3, 2025 plaintiffs filed a motion for a stay pausing the implementation of information sharing agreements between the IRS/SSA and ICE pursuant to 5 U.S.C. §§ 705 and 706 or, in the alternative, a preliminary injunction. In their motion, plaintiffs claim they will "likely succeed on the merits of their claims under the Administrative Procedure Act that the information sharing agreements, policies and procedures are contrary to law because they violate the privacy protections for taxpayer information under 28 U.S.C. § 6103, they are arbitrary and capricious, and they are contrary to the Constitution because the violate the First Amendment rights of Plaintiffs and their members." Furthermore, plaintiffs reported they would face irreparable harm without preliminary relief due to members being afraid to file tax returns out of fear of their information being shared and due to the unlawful data-sharing policies creating a substantial risk of unlawful irreversible civil detention and deportation.

After defendants filed their response to plaintiffs' motion for preliminary relief, Judge Talwani set a hearing for December 19, 2025. In a supplemental filing, Defendants asserted that this court’s entry of preliminary relief would be "unnecessary” because, on November 21, 2025, “the United States District Court for the District of Columbia entered a preliminary injunction against the Internal Revenue Service (“IRS”)."

On January 9, 2026, defendants filed a motion to dismiss the complaint under both Rule 12(b)(1) for lack of subject matter jurisdiction based on standing deficiencies and Rule 12(b)(6) for failure to state a claim. They argued that plaintiffs lacked both organizational and associational standing because alleged injuries such as credibility loss and funding loss were not fairly traceable to defendants' conduct. Defendants contended that the challenged data sharing complied with statutory requirements under I.R.C. § 6103(i)(2) and was mandated by federal law, making claims of arbitrary conduct implausible. They further argued that alternative remedial schemes existed under I.R.C. § 7431, that no constitutional rights were actually affected, and that the Accardi doctrine claim failed because no binding regulations were violated.

On February 5, 2026, the court issued an order and memorandum granting plaintiffs preliminary relief. Judge Talwani's decision followed similar relief granted by a D.C. district court against the IRS defendants in Center for Taxpayer Rights v. Internal Revenue Service. In his reasoning, Judge Talwani found that the data sharing agreements between the IRS and ICE violated federal tax privacy protections under 26 U.S.C. § 6103, constituted agency action contrary to law, and violated the Administrative Procedure Act. Additionally, the court found that ICE's requests failed to comply with multiple statutory requirements under Section 6103, including the failure to identify officers "personally and directly engaged" in criminal investigations and the failure to provide specific reasons for disclosure as required by law. The court ordered ICE defendants to cease all use of the taxpayer information obtained through these agreements and requiring confirmation of compliance by February 10, 2026.

Judge Indira Talwani: ELECTRONIC ORDER: Pending before the court is Plaintiffs’ Motion for Relief under 5 U.S.C. §§ 705, 706 or, in the alternative, for Preliminary Injunction [ 27 ], which Defendants oppose, see Defs’ Opp’n [ 39 ]. In a supplemental filing, Defendants assert that this court’s “entry of preliminary relief [is] unnecessary” because, on November 21, 2025, “the United States District Court for the District of Columbia entered a preliminary injunction against the Internal Revenue Service (“IRS”); the Department of the Treasury; and [Treasury Secretary] Scott Bessent[.]” Defs.’ Notice of Supp. Auth. 1–2 [ 44 ]. Pursuant to the D.C. District Court’s Order, the IRS is now preliminarily enjoined “from disclosing any return information, including taxpayer return information, to the Department of Homeland Security (“DHS”) or any of its component agencies pursuant to [26 U.S.C.] Section 6103(i)(2), except in strict compliance with the requirements of that Section, including that the recipients of the information be “officers and employees of [the receiving] agency who are personally and directly engaged in” a relevant nontax criminal investigation or proceeding and that the recipients will use the information “solely for” that criminal investigation or proceeding.” Ctr. for Taxpayer Rights v. Internal Revenue Serv., 2025 WL 3257096 *1 (D.D.C. Nov. 21, 2025) (footnotes omitted).The court takes judicial notice that, although those defendants have appealed the D.C. District Court’s preliminary injunction to the United States Court of Appeals for the D.C. Circuit, seeCtr. for Taxpayer Rights v. Internal Revenue Serv., No. 26-05006 (D.C. Cir. Jan. 13, 2026), the injunction remains in effect pending the outcome of the D.C. Circuit’s decision. See Ctr. for Taxpayer Rights v. Internal Revenue Serv., No. 1:25-cv-00457-CKK, ECF No. 65 (Jan. 21, 2026). Therefore, regarding Plaintiffs’ request for preliminary relief as to Defendants IRS, the Department of the Treasury, and Secretary Bessent, Plaintiffs have not demonstrated the likelihood of irreparable harm required for a preliminary injunction while the litigation is pending. See Esso Standard Oil Co. v. Monroig-Zayas, 445 F.3d 13, 17–18 (1st Cir. 2006). As to these Defendants, the Motion [ 27 ] is DENIED without prejudice.Plaintiffs argue that injunctive relief is still necessary in this case because the remaining Defendants here are not parties to the D.C. District Court proceeding and are not bound by that court’s injunction. See Pls.’ Reply at 13 [ 43 ].As to Plaintiffs’ allegations regarding impermissible sharing of confidential tax information by Defendant Social Security Administration (“SSA”) with Defendant U.S. Immigration and Customs Enforcement (“ICE”), the court finds that Plaintiffs have not demonstrated a substantial likelihood of success on the merits where the record is not sufficient to make a finding that sharing of tax information between SSA and ICE has or is likely to occur. Plaintiffs rely on a newspaper article that describes a February 2025 data transfer by SSA to ICE, see Compl. ¶ 98 [ 1 ], but the record is insufficient to support Plaintiffs’ claim that the transferred information was confidential tax information (as opposed to other non-tax information held by SSA). Further, Defendants have submitted a declaration from an SSA official, attesting that no sharing of tax information has yet taken place, despite the data-sharing agreement laid out in the August 2025 letter sent by SSA to ICE. See Compl., Ex. D [[1-4]]; Defs.’ Opp’n, Myers Decl., Ex. B ¶ 4 [[39-2]]. Accordingly, Plaintiffs’ Motion [ 27 ] is also DENIED without prejudice as to Defendants SSA and SSA Commissioner Frank Bisignano.Regarding ICE’s alleged use and threatened use of confidential tax information in contravention of 26 U.S.C. § 6103’s requirements, Plaintiffs’ Motion [ 27 ] seeking to enjoin Defendants ICE, DHS, Secretary of DHS Kristi Noem, and Acting Director of ICE Todd M.
