On September 30, 2025, local government entities filed suit in the U.S. District Court in the Northern District of California against the Trump administration. Plaintiffs alleged that for the first time in the 75-year history of Congress’s financial support for state and local governments’ disaster preparedness, mitigation, and recovery, the Executive Branch determined to use this critical federal funding as a cudgel -- threatening to hamstring state and local governments’ emergency-management functions unless they acquiesced to unrelated Executive domestic policy goals. Specifically, plaintiffs alleged the Department of Homeland Security (DHS) had adopted unlawful new conditions in its “Standard Terms and Conditions” that required adherence to the Executive Branch’s domestic political agenda and imposed those new conditions as barriers to Plaintiffs’ acceptance of a range of grants administered by DHS and Federal Emergency Management Agency (FEMA). The new conditions included compliance with the Trump administration’s interpretation of anti-discrimination law, which plaintiff alleged was contrary to statutory and decisional law; agreement to use grant recipient’s limited resources to cooperate with Immigration and Customs Enforcement; and compliance with all current and future executive orders. The plaintiffs argued that these new conditions violated Separation of Powers and the Spending Power, were arbitrary and capricious, were contrary to the Constitution, and were in excess of statutory authority in violation of the Administrative Procedure Act. The plaintiffs sought a declaration that the new conditions are unlawful and unconstitutional, a temporary restraining order, and an injunction preliminarily and permanently enjoining the defendants from incorporating, imposing, or enforcing the conditions.

This case was originally assigned to District Court Judge Edward J. Davila and referred to Magistrate Judge Virginia K. DeMarchi for Discovery, but was reassigned to Judge William H. Orrick on October 8, 2025. 

On October 1, 2025, the plaintiffs filed a motion for preliminary injunction and requested that the court prohibit the defendants from imposing or enforcing the new DHS conditions on the plaintiffs, withholding funding on the basis of those conditions, or imposing materially similar conditions on the plaintiffs. 

On October 3, 2025, the defendants sought an administrative stay in light of the current government shutdown. Judge William H. Orrick denied the motion to stay on October 10, 2025, reasoning that because the plaintiffs face an October 24, 2025 deadline to accept federal government funding, the motion for a preliminary injunction is urgent. 

As of October 26, 2025, a briefing schedule has been set, and a hearing on the proposed preliminary injunction is set for November 19, 2025.
