DHS released her on her own recognizance and initiated removal proceedings in immigration court. The petitioner remained in San Francisco for two years and complied with the conditions of her release. Then, on July 31, 2025, Immigration and Customs Enforcement (ICE) re-arrested her as she left immigration court, without notice or a hearing, on a warrant issued under 8 U.S.C. § 1226.

On August 1, 2025, the petitioner filed for a writ of habeas corpus in the United States District Court for the Northern District of California, claiming that her detention violated her procedural and substantive due-process rights. Judge P. Casey Pitts was assigned to the case. That same day, the petitioner moved for an ex parte temporary restraining order (TRO) that would, among other things, require her immediate release from her ongoing detention and prohibit her re-arrest without a pre-detention bond hearing. Also on August 1, the court granted the TRO and ordered the government to immediately release the petitioner. 2025 WL 2203419.

On September 16, 2025, the court granted the petitioner’s request to convert the TRO into a preliminary injunction and ordered that the government could not re-detain her during the pendency of the lawsuit without first providing her with a pre-detention bond hearing before a neutral immigration judge. At the bond hearing, the government would bear the burden of demonstrating, by clear and convincing evidence, that she was a flight risk or a danger to the community and that no conditions other than re-detention would be sufficient to prevent such harms.

On September 18, 2025, the petitioner filed an amended petition for habeas corpus adding three new named petitioners who were also arrested by ICE while leaving immigration court, along with a motion to certify an injunctive class and a motion for a TRO covering the new named petitioners. The court granted the TRO in part on September 19, ordering the government to release a new named petitioner and prohibiting re-detention absent a bond hearing. On October 15, the court granted the petitioners’ request to convert that TRO into a preliminary injunction that prohibited the detention of the named petitioners without notice and a pre-deprivation hearing.

The government filed a dual motion to dismiss and a motion to sever the individual habeas cases on October 24, 2025. The court has yet to rule on the motion to dismiss but granted the motion to sever. The court denied the government’s request to reassign the severed claims.

The court provisionally certified both proposed classes on November 25, 2025, and granted the preliminary injunction. However, the court found that the plaintiffs failed to establish the need for a stay of ICE’s 12-hour waiver detention policy and denied the motion to stay.

This case is ongoing.
