On January 17, 2025, the acting U.S. Attorney for the District of Nevada resigned. Fahami occupied this position until two months later, when Attorney General Pamela Bondi, appointed Sigal Chattah to be interim U.S. Attorney. Chattah's appointment was made effective on April 1, 2025. Under the Vacancies Act, 5 U.S.C. §§ 3345–3349d, interim appointments are time limited until either the Senate confirms a nominee or the expiration of 120 days after appointment, whichever is earlier. If a permanent U.S. Attorney is not nominated by the President and confirmed by the Senate within that 120-day period, the statute provides that the Judges of the Nevada District Court could appoint their own intermediary U.S. Attorney to serve until the vacancy is filled through the aforementioned appointment procedures.

As in United States v. Giraud III, Attorney General Bondi took several steps to circumvent FVRA's statutory procedures. One day before Chattah's 120-day term expired, Chattah resigned from her position as U.S. Attorney, but noted in her resignation letter that “I look forward to continuing to lead the U.S. Attorney’s Office for the District of Nevada.”  (Doc. 29-2 at 2). Bondi then appointed Ms. Chattah to be a Special Attorney in the Department of Justice under a general delegation statute. Bondi then designated Chattah to be the First Assistant U.S. Attorney in Nevada. In Chattah's appointment document, Bondi stated that, as First Assistant, Chattah would “have authority to serve as Acting United States Attorney . . . subject to the conditions and time limitations of the Federal Vacancies Reform Act of 1998.” Bondi then changed Fahami's title from First Assistant to Executive U.S. Attorney leading to Chattah filling the spot of Acting U.S. Attorney. To date, the President has not nominated anyone else to serve as the permanent U.S. Attorney for the District of Nevada.

Defendant Shamar Tyrell Garcia was recently indicted for a felony offense in the District of Nevada. On September 3, he filed a motion to dismiss his indictment on the grounds that Chattah is not validly serving as Acting United States Attorney. In the alternative, he requested the court disqualify Chattah.

During the pendency of Tyrell-Garcia's motion, Giann Icob Salazar Del Real, Devonte Jackson, and Jorge Enriquez followed similar motions to dismiss. The Nevada District Court Judges recused from hearing these motions, "presumably because the motions would implicate their own power to appoint an Acting U.S. Attorney." See 28 U.S.C. § 546(d). For this reason, the Ninth Circuit Chief Judge Mary Murguia assigned David G. Campbell to handle all the motions to disqualify Chattah.

On September 30, 2025, the court granted the motions to dismiss to the extent they sought disqualification of Ms. Chattah from supervising the defendants' criminal prosecutions. 2025 WL 2784640. Judge Campbell concluded that Chattah was not validly serving under the FVRA and noted that the executive branch's actions were precisely the type of actions Congress wanted to put an end to when it passed FVRA. The court rejected the argument that the Attorney General could still authorize Chattah to supervise criminal prosecutions in Nevada. Therefore, the court disqualified Chattah from supervising the defendants' cases, though it declined to dismiss the indictments.  It reassigned to the Nevada District Judges; the case was reassigned to District Judge Jennifer A. Dorsey. 

On October 2, 2025, the government submitted notice of appeal; on October 10, the defendants filed their own notice of cross appeal. 

This case is ongoing.

ORDER granting in part and denying in part 29 Motion to Dismiss as to Giann Icob Salazar Del Real (1). Defendants' motions are granted to the extent they seek disqualification of Ms. Chattah from supervising their criminal prosecutions. M s. Chattah is disqualified from supervising these cases or any attorneys in the handling of these cases. The government attorneys handling these cases shall, within 7 days of this order, file statements in the docket that they are not being superv ised by Ms. Chattah in their prosecution of these cases. They shall amend the filing if that changes at any time during the life of these cases. Defendants' motions are denied to the extent they seek dismissal of their indictments. These cas es shall be reassigned to the District Judges in Nevada to whom they were originally assigned.
