On October 1, 2025, plaintiff Robert Primus sued President Trump over the government's decision to remove Primus from his position as a member of the Surface Transportation Board (STB) absent a showing of inefficiency, neglect of duty, or malfeasance in office in violation of 49 U.S.C. § 1301(b)(3). Plaintiff has served on the STB since January 7, 2021, and his current five-year term expires on December 31, 2027.
