In one of the most significant tests of presidential power over domestic military deployment in decades, the State of Illinois and the City of Chicago sued the Trump Administration to block their attempt to federalize and deploy the National Guard within Illinois.

Filed on October 6, 2025, in the U.S. District Court for the Northern District of Illinois before District Judge April M. Perry, the complaint alleged that President Donald J. Trump and Department of Homeland Security Secretary Kristi Noem had ordered a surge of heavily armed federal agents into Illinois to conduct civil immigration enforcement using “unprecedented, brute-force tactics.” The plaintiffs allege that agents fired chemical munitions into crowds that included media and legal observers outside the Broadview ICE facility and paraded masked and armed through downtown Chicago. The plaintiffs argued that these actions—and the administration’s subsequent order to federalize and deploy both the Illinois and Texas National Guard—were “patently unlawful” and violated constitutional limits on federal control over state military forces.

The plaintiffs, represented by the Illinois Attorney General’s Office and the City of Chicago Department of Law, brought the case against the President, the Department of Homeland Security (DHS) and Secretary Noem, the Department of Defense (DoD) and Secretary Peter B. Hegseth, the U.S. Army, and Army Secretary Daniel P. Driscoll, all in their official capacities. They sought declaratory and injunctive relief halting the federalization order, along with attorneys’ fees under 28 U.S.C. § 2412.

On October 9, 2025, Judge Perry granted a Temporary Restraining Order (TRO). The court held that plaintiffs were likely to succeed on the merits because the executive’s invocation of 10 U.S.C. § 12406 lacked the statutory predicates of “invasion, rebellion, or inability to enforce the laws,” and that judicial review was not barred by the political question doctrine. The order enjoined federal officials—but not President Trump personally—from ordering or executing the federalization or deployment of the National Guard within Illinois, finding irreparable harm to state sovereignty and the public interest. State of Illinois, v. Donald J. Trump, No. 25-CV-12174, 2025 WL 2886645 (N.D. Ill. Oct. 10, 2025).

The defendants appealed Judge Perry's decision on October 10, 2025. On October 16, 2025, a Seventh Circuit panel granted in part and denied in part the government’s motion to stay the TRO. The court allowed federalization of the Guard to remain in effect but barred deployment of any National Guard forces within Illinois pending appeal, concluding that the district court had not abused its discretion and that maintaining the injunction preserved the status quo. Illinois v. Trump, No. 25-2798, 2025 WL 2937065 (7th Cir. Oct. 16, 2025).

On October 17, 2025, Defendants filed an emergency stay application with the U.S. Supreme Court, asking Justice Barrett to vacate or stay the lower courts’ injunction that barred deployment of federally controlled National Guard forces in Illinois, arguing that the orders unlawfully constrained the President’s Article II command authority
