This case challenges the Department of Homeland Security's (DHS) decision to terminate TPS for nine countries, including Syria. The defendants named are DHS, Secretary of Homeland Security Kristi Noem, United States Citizenship and Immigration Services, and the United States of America. The case was assigned to Judge Katherine Polk Failla.

The dispute arose on September 19, 2025, when the DHS Secretary announced the termination of Syria’s TPS designation. The termination, published on September 22, was scheduled to take effect on November 21. The Secretary stated the termination was justified by the fall of Assad’s regime in 2024, which allegedly rendered it safe for Syrian nationals to return. The Secretary also asserted that Syria’s TPS designation was contrary to the national security policy of the U.S. 

The seven Syrian plaintiffs filed the suit under the Administrative Procedure Act (APA), alleging the decision was arbitrary and capricious and violated the due process and equal protection clauses. The plaintiffs argue that the termination was based on President Trump’s pre-meditated policies, not on the "country-based conditions analysis" required by statute. As evidence, the plaintiffs point to Executive Order No. 14159, issued on President Trump’s first day in office. This order required the “DHS Secretary to promptly take all appropriate action, consistent with law, to rescind the policy decisions of the previous administration that led to the increased or continued presence of illegal aliens in the United States, including by reviewing designations of Temporary Protected Status.”

The plaintiffs allege this current attempt mirrors efforts made during President Trump’s first term. In those prior cases, courts granted injunctions (e.g., 332 F. Supp. 3d 393, 709 F. Supp. 3d 871), finding that the DHS Secretary was largely carrying out and conforming with a predetermined presidential agenda to end TPS rather than fuller evaluation of whether the country would be able to safely accept returnees.

On October 21, the plaintiffs filed a motion for a preliminary injunction, which was partially granted on November 19. The court ordered postponement of the Defendant's termination of the Temporary Protective Status for Syrians in the United States.

Defendants appealed the preliminary injunction on November 24. The case is ongoing.
