This case challenged the decision of U.S. Attorney General Pam Bondi, at the instigation of President Trump, to bypass statutorily-required procedures for reassignment of prisoners and transfer 37 inmates to ADX Florence, the harshest unit in the federal prison system. Following former President Biden’s commutations, Federal Bureau of Prisons (BOP) officials began working with plaintiffs’ lawyers to reclassify and transfer the 37 inmates, according to controlling statutory and policy requirements known as the “redesignation process.” Following Trump's EO 14164 and the Bondi Memo, the BOP categorically predetermined that all Plaintiffs—regardless of the BOP redesignation process's determination—would be incarcerated indefinitely under the most oppressive conditions in the entire federal prison system at the USP Florence Administrative Maximum Facility (“ADX”).

On October 21, 2025, plaintiffs, currently incarcerated inmates in BOP custody at U.S. Penitentiary (“USP”) Terre Haute, Special Confinement Unit (“SCU”), the federal death row, in Terre Haute, Indiana, filed suit against President Trump, Attorney General Pam Bondi, and the BOP. Plaintiffs had previously filed litigation to halt the directive in Taylor I in April 2025. By October the majority of the Taylor I plaintiffs had completed their administrative appeals pursuant to the D.C. Circuit’s strict interpretation of the Prison Litigation Reform Act. Thus, out of an abundance of caution, the plaintiffs moved to voluntarily dismiss their claims in Taylor I. 

In this new action, the plaintiffs alleged that the directive violated their rights to procedural due process and equal protection, the Eighth Amendment, the Constitution’s prohibitions on bills of attainder and ex post facto punishments, the presidential power to grant clemency, and the Administrative Procedure Act. Represented by the ACLU, the Center for Constitutional Rights, a student legal clinic at the University of Denver Sturm College of Law, and private counsel, the plaintiffs sought declaratory judgment and injunctive relief within the U.S. District Court for the District of Columbia. This case was assigned to Judge Timothy J. Kelly.

The day after filing their complaint, plaintiffs filed a motion for temporary restraining order seeking to enjoin the categorical redesignations and restore the original placement designations made by BOP before the Bondi Memo.

In their response to the temporary restraining order motion, the government raised several jurisdictional challenges, arguing lack of subject matter jurisdiction based on no waiver of sovereign immunity under 18 U.S.C. § 3625, which excludes BOP designation decisions from the APA's waiver in 5 U.S.C. § 702. They further contended that Congress precluded judicial review of the BOP’s housing placement decisions under the First Step Act of 2018, and that Taylor I plaintiffs lacked Article III standing for failing to exhaust administrative remedies. On the merits, defendants argued that plaintiffs failed to state claims under the APA because § 3625 foreclosed such claims, neither the AG Memo nor alleged "Mandatory ADX Policy" constituted final agency actions, and placement decisions were committed to agency discretion. They also maintained that plaintiffs lacked a protected liberty interest in avoiding ADX transfer, received adequate process, and failed to demonstrate constitutional violations regarding conditions at ADX. Finally, defendants argued that plaintiffs failed to show the irreparable harm necessary for injunctive relief, contending that concerns about ADX conditions were not well-founded.

Prior to ruling on the temporary restraining order, several plaintiffs sought to intervene in the case.

On February 11, 2026, Judge Kelly converted plaintiffs' temporary restraining order motion into a preliminary injunction motion, and then granted the motion on the plaintiffs' Fifth Amendment Due Process claim. The court found that the redesignation process was likely predetermined, violating due process requirements, based on evidence including: the Executive Order's punitive intent, DOJ's intervention in the ongoing BOP process, the identical ADX Florence designations for all commutees, and one administrator's alleged admission that he "had to do what [AG Bondi] directed him to do." The preliminary injunction prohibits all defendants, except President Trump, from transferring any plaintiff to ADX Florence during the litigation, with plaintiffs remaining at their current facility in Terre Haute.
