Following former President Biden’s commutations, BOP officials began working with plaintiffs’ lawyers to reclassify and transfer the 37 inmates, according to controlling statutory and policy requirements known as the “redesignation process.” Following Trump's EO 14164 and the Bondi Memo, the BOP categorically predetermined that all Plaintiffs—regardless of the BOP redesignation process's determination—would be incarcerated indefinitely under the most oppressive conditions in the entire federal prison system at the USP Florence Administrative Maximum Facility (“ADX”).

On October 21, 2025, plaintiffs, currently incarcerated inmates in the custody of Defendant Federal Bureau of Prisons (“BOP”) at U.S. Penitentiary (“USP”) Terre Haute, Special Confinement Unit (“SCU”), the federal death row, in Terre Haute, Indiana, filed suit against President Trump. Plaintiffs had previously filed litigation to halt the directive in Taylor I in April 2025. By October the majority of the Taylor I plaintiffs had completed their administrative appeals pursuant to the D.C. Circuit’s strict interpretation of the Prison Litigation Reform Act. Thus, out of an abundance of caution, the plaintiffs moved to voluntarily dismiss their claims in Taylor I. 

The plaintiffs filed a new action against President Trump and AG Bondi as defendants, as well as other DOJ and BOP officials and the BOP itself. The plaintiffs alleged that the directive violated their rights to procedural due process and equal protection, the Eighth Amendment, the Constitution’s prohibitions on bills of attainder and ex post facto punishments, the presidential power to grant clemency, and the Administrative Procedure Act. Represented by the ACLU, the Center for Constitutional Rights, a student legal clinic at the University of Denver Sturm College of Law, and private counsel. The plaintiffs sought declaratory judgement and injunctive relief within the U.S. District Court for the District of Columbia. This case was assigned to Judge Timothy J. Kelly. The plaintiffs subsequently filed a motion for temporary restraining order. 

In their response, the government claimed that the court lacked jurisdiction over the Plaintiff’s claims because the U.S. is immune from suit, even under the APA. Even if the U.S. was not immune, the First Step Act precludes judicial review of the BOP’s housing placement decisions. Additionally, the government contests the plaintiff’s claim of a  “mandatory ADX policy” – rather the BOP redesignates the plaintiffs based on inmate specific transfer review and hearings on the matter. Given that the plaintiffs did not identify a liberty interest, received adequate process, and did not establish that they were treated differently than other inmates in their circumstances, their other claims would fail. The plaintiffs also failed to demonstrate irreparable harm from redesignation or temporary confinement at ADX.  

After hearing oral arguments on the motion for temporary restraining order, the judge ordered the government to provide 48 hours written notice of any transfer of plaintiffs to ADX.
